    J-Square Fencing was contracted by ****’s for a new fence installation. They failed to show up for multiple installation appts, failed to complete contracted work and/or poorly completed contracted work, and installed fencing in location not specified in Contract, ****’s Fence Worksheet, or Approved Change Order. ****** from J-Square stated on 6/28/23, during a 3 -way call with me & ****’s Fence Installation Support Team Rep, that J-Square reps will not return to my residence to complete any work or fix incomplete work.
    Contracted work: A. Install 88’ of fencing (extending from existing fence and going over the utility box), B. Replace one 8’ damaged panel (by the driveway), and C. Install 16’ of fencing in L shape on west side of house.
    Issues with current fence installation that have not been addressed:
    a. The existing fence section adjacent to replaced 8’ panel replaced on 6/4/23 by the driveway is damaged/out of alignment not allowing the bottom rail to seat into the post. Also, end post along the adjacent section of fencing is bent out of alignment. Damage was due to improper replacement of panel.
    b. Fence post caps from fencing installed 6/3, 6/4, and 6/26 were not properly installed (did not apply silicone between the cap and fence posts).
    c. Current 80’ of fencing installed 6/26 was contrary to ****’s Fence Worksheet, homeowner’s text on 6/22, and metal pin installed into the ground to show where to begin the fence (and documented in pict texted to ****** @ J-Square 6/22).
    d. There is no code which prevents installation of new fence to match existing fence that runs along the same marked utility lines. ********************************************************   states, “If you must excavate within the tolerance zone [18”], dig next to the marks, not on top of them. Hand dig, pot hole or vacuum excavate with extreme caution.”
    e. Current 80’ of fencing installed 6/26 is not parallel to current fence or the south property line. It is crooked.

    The photo the customer is sending you with the electrical line, is the existing fence that was not installed by J Square Fence. It has nothing to do with us. We are required by law to stay 18" off any utilities marked by JULIE service. This was the only spot the fence could be placed. Any further the other direction would have been on the neighbors property. You can see the red electrical line and the cable line. The fence could only go between the two to remain 18" away from electric and cable lines. We spent hours explaining this to her, she agreed to put the fence exactly where we put it. I have uploaded the fence that we installed showing the lines. The customer was 100% aware that it would be offset from the old fence. If she hadn't agreed to it, we would have never installed it. Her exact words were "that's fine, ill just plant a bush or something in the gap". This was her only option. The law states 18" for a reason. If we were to hit an electrical line someone could be severely hurt or killed. We would also be fined thousands of dollars. Just because the previous company didn't follow that law, does not mean that we are going to break it.

    I am rejecting this response because:

    There is no evidence in writing of me agreeing to offset the new fence from the existing fence that ****'s installed in 2020.  The only discussions with installer was for an explanation why the new fence couldn't align with the current fence, since the current fence runs along the same marked utility lines.  I attached documentation from illinois1call.com which clearly shows there is no law preventing digging within 18" of marked utility lines and the website advised of approved dig methods when digging in the caution zone.  The contract was for the new fence to align with existing fence. This installer is deceptive and deliberately chose to install the fence where it was easiest for them to install without my approval and without me being present.  Not only did they install it offset, it is crooked and the fence post caps were not adhered with silicone to the fence posts. They did not install the fence per the ****'s installation worksheet and have no change order allowing a deviation.  They were unwilling to utilize alternate digging methods specified in illinois1call.com to allow the new fence to align with current fence. Installer should have refused to install the fence instead of unilaterally choosing where they would install it. The installer makes remarks about my property line.  Aligning the new fence with my current fence is within my marked property line.
