Subject: Formal Complaint Regarding Unreasonable Delay in Vehicle Repairs and Lack of Communication Vic Koenig ChevroletI am writing to lodge a formal complaint against Vic Koenig Chevrolet in **********, **, regarding the unacceptable delay and lack of communication in the repair of my fathers vehicle, owned by Mr. ******* ****.The vehicle has been at the dealership since March following a collision with a deer. Im a heart patient need to get to an from my medical appt. While insurance has approved the repair, the vehicle remains untouched months later. Repeated attempts to obtain a status update or estimated completion date have gone unanswered. No loaner car which has been given to other customers.Additionally, despite our ongoing hardship without transportation, the dealership has failed to provide a loaner. We were told conflicting things first about a waitlist, then a prioritization policy. They gave it to the white customers. This extended **************** of customer service appear to violate fair consumer practices as outlined by the Illinois Consumer ***************** Business Practices Act. Furthermore, in ******* *. *******, 245 N.J. 84 (2021), the ************************ held that dealerships cannot use restrictive insurance clauses to avoid responsibility for loaner vehicles, reinforcing the expectation that dealerships must act in good faith when providing temporary transportation during repairs.I am formally requesting that:Chevrolet Corporate investigate this matter & urge the dealership to take appropriate action. The AGO consider this complaint as a potential violation of consumer rights. The BBB help mediate a timely resolution & document this experience ***********. Their Silverado was brought in with considerable body damage. The customer did not want us to fix any damage only an axle issue and a couple of other items. Parts were ordered and all of the parts came in except one small part was unavailable and on back order and not available anywhere. Usually when a customer has collision damage they will have insurance coverage for the damage and rental car coverage to provide a car. We do not have long term rentals , only a couple vehicle's that are insured for a customer do drive for 1 or 2 days while we make a quick repair. I assume this customer did not have coverage since they were not having us fix the body damage. Right now the missing part finally came in and was installed and the customer is driving their truck. We are sorry it took so long but it could not be helped due to supply of the part.Initial Complaint

I would like my complaint reopened to respond. car would shake. I researched and found out the engines in these cars have been on recall and they have had lawsuits from them smoking and even starting fires. July 26, 2024, my mother took my car and it stopped and said, "Pull over and cut off car" and continually beeped at her and alarmed. She has the video proof as well. This is documented at the Watermark **** ******* Dealership in ******, ******** where the car currently is. It went in and had sensor change and the issue continued. January 12 of this year, i had took it to the store and I couldn't go over 15 mph. It smelled like smoke and my car inside was very smoky I got worried and had it towed. I have photos and have been told its the *** valve but sludge is in my engine. It's been in the shop for 3 months and *** ******* have told me it's nothing they can do. I believed I was sold a bad car and nothing is being done. I can email photos and proof if needed. I am paying for a car I can't drive and just wanted something done.Business Response

Sorry for the delay in answering we couldn't find his name in our system or vin number on the complaint so after some digging we found out its in the name of ***** *****. We contacted ************** where the car was. They tell us its been fixed for 2-3 months but no one has picked it up. They tell us Mr. ************ worked at ********* **** at one time but doesn't any longer. ********* says the bill is around $600 to $700 but it is not covered by any warranty. I see when the car was purchased they did buy an extended service warranty that would have covered for 24 months and ****** miles. It must be over on the mileage or its not considered a covered item. Unfortunately there is no coverage for this car.Customer Answer

I have reviewed the business' response and am rejecting it because I have the messages from the company. It was there months due to weather and delayed parts on their end also **** being sick. Ive reached out and called many times as well but received no answer and apologies about not getting to me which I understand. I asked a timetable because I would be out of town and just returning from vacation to again recieve no response. I have only had the car a year and a half and Ive continually had to bring it in to *** ******* and I was told nothing was wrong. I was misled about the car mileage from the start by **** (salesman) when the car was purchased and had to have it towed multiple times. I understand issues with a car completely thats how things go, but after digging that the car I have, the engine in it is a 2.4L Theta II, which ******* has had engine issues with and there was a class action lawsuit on these engines which start happening around 70k thousand miles, which I am at. I was only aware of this from a friend who had the same issue. I wasnt notified of this and I had all my maintenance done each time it was needed. Ive driven the car minimum miles out of fear that it would stop on me on the highway or just completely go out. I again understand cars have problems, thats how things go I take care of the car and I brought it in 6 times to ensure its okay, but if the engine was already bad, its nothing I can do. I cant drive a car Im unsafe in especially for work or for travel with my family.
Sincerely,
***** ******Customer Answer

The car I purchased June 12, 2023, I was told it was 52k miles and it was 72k miles and the salesman **** apologized for saying that. I find out the engine had a class action lawsuit on them and THETA II 2.4L and the cars had knocking noises, smoking, and even starting fire. My car has did it multiple times of knocking, stalling, and the last day of smoking with the engine. I felt I was sold a bad car from the start, and they werent honest to me about it. If the engine goes out at 72k with those cars or having issues, I shouldve been notified. Ive been told to call back or not returned calls from *** ******* explaining this issue and my mom has as well. I wanted to purchase a car with safety and I do not feel safe driving that car. It was my first time purchase and it wasnt a good experience for me. I have messages and family friends as well who have had a similar experience with *** ******* (I cant get her info as well).Business Response

When you bought the car it had ****** miles on it. All of the sale documents show the mileage of ****** which you signed many times. If there was really an issue with the miles it would have come up then. I talked to ****** **** and again they tell me the car is completed and has been over a month or more. The bill is $612 and that was for a new EGR Valve and checking out the sputtering issue. They believe it is fixed. You have put over ****** miles on the car and have had it for almost 2 years now. I don't think its our responsibility to buy you a new car since it ran well for such a long time.Customer Answer

There was an issue when we notified the salesman about it and we only got an apology. It was listed at 52k miles. He wouldnt apologize for something that was right if there wasnt a reason to and wouldve notified us of this. His name was **** and again, proof of this from him speaking to my mother about the issue. The service guy at ************** told me I would have to bring it back to be looked at because from the photos, its sludge in the engine which may cause further breakdowns. It was for the *** valve solely not the sputtering issue. I again have proof from the messages he has sent me stating this, so no they dont believe its fixed if he tells me Ill need to bring it back in. The car is there yes because I told them I would be reaching out to *** *******, again, the day before I left for vacation and even notified them that I could possibly have someone come by and get the car for me, but received no response. Also, the car did not run well for such a long time which is why the current situation is where it is now. Ive had it in the shop six times and towed twice from June 2023-January 2025. I again state its impossible to travel for work or anywhere with a car that sputters and shakes and clearly has a bad engine. I had child in the car the last time it was towed and the engine started smoking. Thats extremely unsafe. I have my paper work as well and only two oil changes so I would like to see the 13k miles on it please . Every time I brought the car in, I was told it was fine and told the service guys to drive for an hour if they have to and get up to 70mph so they could experience it, just so they could see the issues I dealt with when on the interstate to tackle the issue multiple times, which also goes back to the class action lawsuit on the exact same engine that is in the car I have at around the same mileage. If they never saw this issue in the photos with the sludge in the engine, Im convinced they werent checking anything because those photos of the engine arent in just 2 years, especially when I have had it regularly checked on time and outside of schedule times.
Sincerely,
***** ******Customer Answer

I was wondering if my input on anything was taken into consideration. *** ******* hasnt attempted to help in any situation. Ive stated the car issues and times Ive taken it in there and every time I was told it was okay, yet I had to keep bringing it in. I do not feel safe driving the car as I have for the last year. The lawsuit on the engine that I also have in the photos attached shows that exact engine with the lawsuit. I can pay for the car and have it taken out, but Ill have to take it back in to be fixed over and over when it could just be resolved from them fixing the issue in the engine. For the complaint to be closed with no resolution of any sort is disappointing, but I dont know what else evidence I have to provide while they have provided nothing.Initial Complaint

She purchased a Colorado in July, she has been in the shop for Bluetooth issue and we fixed that. She has some other problems that can not be duplicated. This is the only two times that she has been in. I am unaware of any other issue. Her car has a warranty and we are willing to assist the consumer.

As far as we know she has only been here twice. The first time she had a radio problem and we did an update on the trucks computer to fix the problem as instructed by **. We believe that fixed the problem. The second time she came in complaining about a light that came on while driving. We could never duplicate the problem and everything looked fine. As far as we know we have not had any communications with her at all and really don't know what she is unhappy with. If she wants to call or come in we can attend to whatever she is unhappy with. I would expect the truck to still be under warranty as long as she is under ****** miles.Customer Answer

On 12/07/21 I brought my vehicle to the service department for the first time, after I noticed the car making a chirping noise and separately leaking fuel. The car had ***** miles on it at the time. *** Koenig service notified me that I needed to replace the following components:1. Fuel sending unit (located in the passenger side fuel tank)2. Crank pulley 3. Crank pulley bolt 4. Alternator belt 5. They also recommended repairing the passenger side fuel after it cracked. The repairs they performed did not solve any of the problems. The fuel tank cracked in the same spot as the repair within 7 months and ***** miles, resulting in me having to purchase a new fuel tank ($207.02) and have it installed at my expense ($650.00) on 9/12/22.The replacement of the broken fuel sending unit in the passenger side fuel tank failed within 1.5 years and ***** miles, resulting in replacement ($634.90) and installation ($196.94) of a new unit at my expense on 7/14/23.The replaced crank pulley broke again within 1.5 years and ***** miles, resulting in the second replacement of the crank pulley ($490.43), bolt ($33.99) and installation ($1380.26) at my expense on 7/14/23. The crank pulley then came loose slightly over 1 year later after ***** miles, resulting in its reinstallation ($899.75) by a third party repair shop at my expense on 8/3/24, solving the problem. The crank pulley coming loose also damaged the alternator belt, necessitating replacement ($101.89) at my expense. On 3/22/22 Vic Koenig Chevrolet recommended I replace the driver side window regulator. The replacement of the broken window regulator with dealer supplied part resulted in water leaking into the interior, as well as loud wind noise, even after taking it in for adjustments ($130.00), resulting in the replacement ($347.56) and installation ($304.88) of a new regulator at my expense 8 months later which solved the problem.I would like compensation for all work that had to be redone, totaling $5170.60Business Response
