    On February 13, 2024, I originally wrote to Ferrara Candy explaining that when I bit into one of their large Chewy Sweet Tarts candies, it **************** and I had to have a dental crown replaced. I sent them images of the tooth damage, invoice for the dental work completed. The incident happened on February 2, 2024. I got in to see my dentist on February 8, 2024 and he charged me $150.00 to take x-rays and pictures of the damaged tooth and file it down. We set up an appointment for February 28, 2024 to have the tooth replaced with a crown for a cost of $1865.00. I sent them both the bill for exam and the quote for future work completed. This work WAS done on February 28, 2024. Ferrara assigned an incident number ********. They had me mail in the other pieces of the candy from the package to assess them. They assigned a claim with their insurance company Travelers. They denied my claim indicating there was nothing wrong with the candy and the specs tested ok. I challenged this, advising that I still had the actual piece of candy that I had spit out that had pieces of my ************* in it. I told them that if I sent that in for testing, I wanted the evidence saved and returned to me. They once again denied my claim for any recovery of money paid out to fix the dental damage caused by their product. I have reached out to the claim adjuster numerous times asking for her to have my evidence sent back and she is less than responsive, finally recently telling me that I have to contact Ferrara directly but providing no contact information when asked as to who to reach out to. I would like my money for dental work refunded to me OR my evidence returned so that I may seek legal counsel. I paid $2015 to get dental work completed that I request be refunded to me since my tooth was damaged as a result of their candy being faulty. I have had this candy numerous times in the past with no problem, but this time they were hard as a rock and chipped my tooth.

    (Ferrara) was unable to produce proof that their product was safe for consumption. We requested a certificate of analysis for the batch involved and they were unable to produce any documents to prove the batch was inspected at all at the time of production and distribution. They advised the batch was only taste tested. Furthermore, there is no warning on the label to consumers with respect to possible reactions for the ingredients contained inside their candy. This failure to warn is negligent and the candy would not have been purchased or consumed had it been there. The reaction to the product was preventable and for these reasons the company would be liable.
