    I cancelled my membership with a gym but they keep billing me. They recently billed me for $224 despite me having cancelled and not resumed services for months.

    To Whom It May Concern,

    **** was a member of our club under a signed contract.  This contract outlines our club policies, including our cancellation policy, which is the same for all members.  This policy states that members are obligated to one future month's billing following the written request of cancellation.  As such, per ****** cancellation request, submitted 9/2/2024, he would be obligated to October's final month billing with a cancellation effective date of 10/31/24.  I've attached ****** original signed contract, along with his signed cancellation request.  I've also included the cancellation confirmation email he was sent from us following his request.  **** stated he did not want to pay these final dues and changed his banking information in our system portal so that we were unable to draft this final balance.  As such, the membership was terminated and submitted to our third-party Profit Recovery company.  Lakeshore Sport & Fitness followed the same cancellation policy we hold all members to.  Please let us know if there is any further documentation required and we'll be happy to assist.

    The gym in question price gouges its customers. It states that per its policy, it requires two billing cycles notification before quitting the gym. I canceled my gym membership December 1st, 2023 and was charged not only for the full month of December 2023 but also the January **** month. There is no reason they need two months notification before quitting. They are forcing me to pay money for services that I am not receiving. This is just a way to extract additional profits from their customers. While the amount I pad is relatively minimal, given that this is the gym-wide policy, you can imagine that there are other victims of this unethical policy which may add up to a material amount of money.

    All members are billed on the 1st of the month making any cancellation request on the 1st of the month take effect at the end of the following month.  This is spelled out in the agreement and needs the buyer to initial that they understand prior to proceeding.  I have attached the agreement in question.  The 1st clause of the membership agreement explains the policy.

    I am rejecting this response because: Cancellation occurred on December 1st, 2023.  Per Section 1 of the contract, cancellation is to occur 30 days before the end of contractual term.  30 days from December 1st is December 31st, so my cancellation would take effect prior to the beginning of the next billing cycle which occurs January 1st 2024.

    The verbiage is:

    "All cancellations will take effect 30 days from the last day of the month the request was made". 

    The request was made in December.  The cancellation will go into effect 30 days after December is over, making January the last active month.  You still have access for the entire month of January.

    Lakeshore Fitness has some ridiculous membership cancellation guidelines and troubling billing practices. The signed contract when becoming a member states nothing about cancellation requirements, but their internal policies that you get to see after you sign a contract to become a member vaguely state that they require a month advanced notice to cancel a month-to-month policy. Already a fairly outrageous policy and does not explicitly state anything like 30 days or anything clear. I tried canceling my membership on August 1st and they said they would **** me until September 30th. After calling the business office and getting no resolution (while I was assuming theyd admit their lack of clarity in a policy that I didnt even sign) I figured Id make a complaint on one of the most ridiculous and deceptive gym billing practices Ive seen. Reading some ****** reviews, it seems Im not the only one.Id like my billing adjusted and removed for my August and September payment. (Approximately $230)

    Lakeshore Sport & Fitness strives to ensure that all members are treated fairly.  Our cancellation policy is clearly stated on all member contracts, on the *** page of our website, and on the Cancellation Submission Form Link.  I've attached a copy of this member's signed contract and highlighted the cancellation section, which also contains his initials.  Included is also a signed copy of this member's Cancellation Request Form.  The cancellation details are also highlighted on that form, above his signature.  The cancellation confirmation email this member was sent via email also details the specific policies surrounding cancellation requests, including the exceptions we make for same month cancellations.  While we understand that this was not his desired outcome, the same policy is upheld for all members of our facility to ensure consistency and so that nobody feels we've given preferential treatment.
