    Landscaping service: pavers on each side of walk way into the house and a small part at the back yard. A retaining wall in front of the bay window.Deposit given on June 4, 2024 of $2000, 1st installment to hold start date.2nd installment of $2024 paid on June 17, 2024.3rd installment of $ 500 paid on June 19, 2024. Chavez Bros Lawncare Services LLC decided to breach their contract and are refusing to return the $500 on the 3rd installment but agree to return the 2nd installment only of $2012.I request they update their cancellation contract with the additional of $500 to be returned and have not received a response back.Looking for a total refund of $2512 in 15 days!!

    We decided to terminate contract with this client because she wanted us to work illegally without permits. She didnt want to wait the time for the permit to be taken out. We offered the attached proposal where we would only keep the amount of $2,512.00 to cover the material and labor that had been spent up to that point. And offered to refund the rest within ***** days va check. All this was explained to her and offered view email and were still waiting to hear back from her. We only intend to keep what was spent not a ***** more. I also explained to inspector that stopped by that this client wanted us to work without permits. This customer is very difficult to speak with I tried explaining in different forms why we couldnt work without permits but she insisted we work after hours or on the weekend. Please call me if you have any further questions **********.

    I am rejecting this response because: I am NOT satisfy with the decision of Chavez ******** care services LLC due to the facts:

    1. Chavez Bro was informed of the inspector on June 21, 2024.  They followed up on Monday, June 24, 2024  by going to the village of ********** and then by phone, and via email to ************************* (inspector) because he was not in the office.

    2. Chavez Bro assured me on June 24, 2024 about mid day via phone call that they would file a permit because it was needed.

    3. Chavez Bro mentioned I wanted them to work illegally but being a LLC company, they should know that they can work up to 30 days while the permit is being processed. I was not given a stop order from the inspector so legally Chavez Bro could have resumed the scope of work. The violation was dated June 28, 2024 and arrived via mail  July 8, 2024.  Contact was canceled by Chavez **** on June 25, 2024 via email approximately 2am.

    4. Chavez Bro decided to breach their contract on June 25, 2024 via email about 2 am so with that said, the refund is correct on the second installment of $2012!

    5.  The partial on the 3rd installment of $500 was given due to the attached text on June 18, 2024 at 8:05 am from Chavez Bro, stating financial set back. (see below)

    6. On June 24,2024 at 1:26 pm is the text response after I had requested the $500 for helping them out in a bind. I helped them and now they cancel on their own and they took advantage of the situation and are trying to keep the additional $500. (see below)

    7. I am requesting the additional $500 in total refund of $2512 within 15 days upon agreement on an updated cancel contract by Chavez ****!

    This is the second time we are answering to this same complaint from client. Like we stated the first time this customer wanted work to be done after hours and on the weekend without permit. Her own complaint states there is no stop order but the inspector made it more than clear that without a permit we could not work and would face violation fees if we continued working. The customer does not understand this and is turning this into a personal issue. Attached is the proposal we have given her twice now. We only intend to keep the amount of $2512 to cover labor, materials and rental fees up to the last work day not a ***** more. Attached is also invoice that was given to her proving this number. Customer was never forced to give more than what was agreed. She made payments willingly. She has also been advised to take legal action if shes unsatisfied with our proposal but theres is no making her understand. We are truly sorry shes getting BBB involved when we have been transparent with her. Please call ********** if you have any other questions. Our proposal is just and fair but the customer wants more. At this point we are also stunned with her actions. We have been civil with her after she continues to call us. Shes lives in an uncorporated area that requires working permits. Were just trying to follow the law and inspectors orders. We stopped all work and offered refund when customer wanted us to work illegally and began harassing us. At that point we no longer felt safe working at her residence and have continued to kept things civil shes just unhappy with our proposal. We hope you can make her see this since we obviously cant make her understand.
