I am filing this complaint after multiple unsuccessful attempts to receive a refund of a $5,900 deposit paid by me to Mr. ****** ******* from Capital Painting and Restorations for a deck construction project at our residence. In Mar 2024, we requested a quote for a backyard deck, and Mr. ******* provided an estimate of $12,000. After signing the contract in Mar 2024, after which Mr. ******* began the process of obtaining a construction permit from the Village of ******************. Despite several weeks of effort, Mr. ******* failed to secure the permit. Village officials informed us that Mr. ******* had not provided the required specifications, which were clearly outlined on their website, and that he struggled with basic instructions. In contrast, Mr. ******* described the officials as difficult to deal with. After three months of delay, Mr. ******* hired an architect to create the necessary diagrams, but at no point mentioned additional charges for this service. On July 27, Mr. ******* informed us via text that the diagrams would cost an extra $1,750, to be paid directly to the architect. The architect, however, assumed that cost estimates had been communicated by Mr. ******** which they had not. We immediately objected to the unexpected cost increase for something that should have been included in the original quote. Since July, we have repeatedly requested a refund, as no work has been completed in six months. Mr. ******* refused, instead demanding $2,000 for his time and effort and suggested legal action if we wanted the deposit returned.I also offered to proceed with the project using the existing deposit, but Mr. ******* insisted on further payments. His refusal, paired with numerous similar complaints found in online reviews, suggests a pattern of fraudulent behavior. We seek mediation and support from the BBB to recover the deposit and also recommend an investigation into Capital Painting and Restorations to prevent further harm to other customers.
