Contracted to fill and seed a low spot (a shallow dip where a tree was removed 1.5 years earlier that had about a 6 foot diameter). Berry's arrived 10/16 without any notice and I just happened to hear them. Berry's threw a few shovels of dirt in the center of the depression and seeded it. Berry's agreed to fix the problem on 10/18. Berry's arrived 11/6 and shoveled enough dirt to fill the low spot and then stopped. I asked about seeding and at first they did not have any. I heard someone mutter "it probably wouldn't grow anyways". Then Berry's said they had a little left in the truck. Berry's applied a fine dusting of seed and then went back to their store to get hay.

    See the attached letter.

We apologize for this problem. We do our best to take care of problems that comes up. This complaint
slipped through the crack. I was not made aware of the problem until this complaint was received.

I spoke to the supervisor to find out what the situation is. We have created a work order for repair this
spring. This is not the time to do any soil/seed work. We are in our winter season and all our crews are
layed off. My supervisor, *** ******, will visit the site this next week and will contact the customer. We
will make any repairs in the spring when the weather is conducive to work will dry soil and the
    temperature is correct for seeding.

The comment that the crew made about "it probably wouldn't grow" is because the soil temperature at
that time was too cold for seed germination. Some of the seed could germinate in the spring when soil
    temperature is above 60 degrees.

We will take care of this in the spring.
