      This is the second complaint. The business never responded to the initial complaint. Im seeking for the association to hold the owner of apartment 309 at *************** accountable to replace flooring that is causing a lot of noise when tenants are walking. The noise is unbearable. Its caused anxiety, waking up in the middle of the night, waking up in early morning of the hour. Ive had to seek medical attention due to palpitations that were caused due to this noise. I have recordings of the noise. My landlord has made several attempts to request replacing of the floor by the owner, the owner is refusing. The apartment was inspected for the noise and its been identified by a contractor that replacement is required. The noise is very unbearable, causing stress and anxiety. There needs to be accountability for the owner and a resolution.

      I am a tenant in apartment 209. The flooring above me in apartment 309 have a lot of noise causing my walking movements. *** complained to my landlord as sleeping has been very difficult. Coming home to relax and distress has been impossible. When movement occurs from walking there are cracking noises. I have recordings that were shared with landlord. The landlord personally paid for new padding in the upstairs apartment hoping this would help because he heard the recording, however this didnt help. He brought a contractor named **** that heard the sound in person because the landlord and the contractor came to the apartment to hear this. The owner of upstairs apartment who is renting out this unit is refusing to do anything about the floors. Ive had heart palpitations and anxiety due to the stress of being woken up on the middle of the night from cracking noises in bedroom and living room. The neighbors have two kids that are very active. Jumping and running occurs as early as 7am and as late as 11pm. Ive had to put my tv loud so that I can try and cancel the noise. *** went to the cardiologist and went through numerous of tests due to the anxiety, palpitations and stress this matter is causing me. The landlord advised that the upstairs owner indicated it is not in his interest to fix the floor. Previous owner of this apartment has made complaints regarding the same issue. The association didnt do anything about it nor did the owner from upstairs apartment. I have recordings I can provide of the noise. The association is not holding the owner accountable at all. I think the flooring is very old and needs to be replaced. My lease is not up until June, but I feel that this should be resolved by fixing the floor and instead of me moving out. I think this is inhumane that someone feels they cant rest in their own home they pay bills to live in.
