    American Music World took my piano on consignment and agreed to pay me $10,500 once it sold. They sold my piano in early 2022 but have not issued any payment and have not responded to my repeated attempts to collect. I provide the full details below.On June 23, 2020, American Music World's *** "****" Fajmon picked up my ****** C3 piano with serial number ******* (the "Piano"). Both **************** and I signed the attached receipt, which states "A.M.W. **** to email contract" and "******** less 25% to [my name]" (the "Receipt"). After not receiving said contract, I emailed **************** on August 22, 2020, to inquire about its status. **************** replied the next day by emailing the Contract, which states that "American Music World will sell this piano and upon the sale of this piano [my name] will receive $10,000.00 ($******** less 25% fee) when the piano is sold." **************** had signed the Contract on August 23, 2020. I responded with my acceptance by email on the same day.In May 2022, my husband contacted American Music World by phone and email after noticing on American Music World's website that the Piano had sold (see attachment). My husband spoke and emailed with ***********************, who indicated that a series of misfortunes had occurred within the American Music World family and stated that "over the coming weeks, we will make a concerted effort to locate your piano and/or the associated paperwork. We will be available to update you on what we are finding." My husband immediately responded with copies of both the Receipt and the Contract to assist with that process, but to date, we have not received any updates or the $10,000 I am due. My lawyer sent a demand letter in September 2022 but also did not receive any response.I attach the Receipt, the Contract, and a website capture showing that AMW sold the Piano. I would like to receive the payment I am owed. Thank you.

    I am rejecting this response because:

    While in principle I accept the business' proposed resolution that they pay the sum owed in installments, there are different terms to which I insist, and my complaint will not be resolved until I receive the full $10,000 that I am owed.

    Specifically,the business proposed "that American Music World begin paying this off at a minimum of $1,000.00 a month, but, with an effort to get this taken care of as quickly as possible."  I understand that the business has encountered financial difficulty, so I will accept monthly installment payments in lieu of a lump sum.  But given that the business continues to accept and sell pianos on consignment, and that it rebuffed my earlier attempts to resolve this issue, I do not trust and cannot accept a proposed resolution that would allow American Music World to continue to delay full payment for nearly another year.  

    To that end, I agree to their proposed resolution so long as (1) payments are rendered in amounts no less than $2,500 each and are made via wire transfer per instructions to be provided; (2) I receive the first payment of no less than $2,500 on or before December 31, 2022; (3) I receive each payment thereafter on or before last day of each subsequent month (e.g., second payment will be due January 31, 2023, and so forth); (4) I will accordingly receive payments totaling the full $10,000 due by no later than March 31, 2023; and (5)the BBB will not **** my complaint as resolved until I receive payments totaling $10,000.

    I will promptly transmit wire instructions should American Music World agree to these terms.  In the event we cannot reach a resolution in this forum, I am prepared to take this matter before the DuPage County small claims court without delay, seeking the $10,000 I am owed in addition to interest and costs.
