    We have signed contracts for a large installation with this client. The project involves significant hardscape elements which must be approved by the ********************* as there are restrictions on permeable surfaces and other elements. The two original contracts were signed on 3/16/2022 and 4/6/2022. The permitting process has taken longer than anticipated. In addition, the scope has now changed as the client communicated to us that they did not intend to proceed with most of the hardscape elements, for which we were seeking the permit and have procured a large amount of material. Additionally, the remaining work that the client, as of 9/30, desire to proceed with, includes grading that still requires the Village's approval. The client has paid deposits in accordance with the contract and we have retained those funds as permitted by the contract. No monies have been "stolen", as is alleged, and no breach of contract has occurred on the part of Greenwise Organic Lawn Care.

    The client has engaged legal counsel in this matter and asked us to direct all communication through counsel.

    I've attached the original signed contracts. There are many change orders that have been agreed upon by the client for changes to scope, which we are also willing to provide if necessary.

    While there have been unanticipated delays in the permitting process, we have sought permit approval, purchased material and attempted to move this project forward to the best of our ability. We believe the allegation of theft of monies is without merit and defamatory in nature.
