    On June 25, 2024, while traveling on Expressway ***** towards downtown *******, I experienced a catastrophic failure of my vehicles right-side tires prior to reaching the ************ exit. Upon safely pulling over, I assessed the damage and discovered that both tires had been irreparably damaged by sharp debris on the roadway.I subsequently proceeded to the ************* dealership in *******, where a mechanic confirmed that the simultaneous failure of both tires was attributable to hazardous metal debris on the expressway. Attached to this correspondence is the invoice for the replacement of the damaged tires.Following the mechanic's assessment, I reported the incident to the ************************************* (****), emphasizing that the debris on the expressway, exacerbated by ongoing construction in the area, constituted a failure to maintain safe road conditions. In response, **** indicated that they would forward my claim to their insurance provider. Dunnet Bay Construction Company, subsequently denied any responsibility for the damages. Stating it could have been something else. The damaged tires and he proximity to the construction where it occurred suggests that Dunner must take responsibility. Their letter did not provide me with an appeal option which is typical in such cases.I spoke with ***** ********* on 11/1/2024, Region One Claims Litigation Manager of **** who indicated to me that Dunnet Construction is primarily responsible as the insured for the road on which the accident occurred and IDOT is the additional insured. **** stated that Dunner must take responsibility for that entire areas road safety as the primary insured.Enclosed are photographs of the damaged tires, the denial letter from Dunnet Bay Construction, and the invoice for the tire replacement. I formally request that Dunnet Construction accept responsibility for the damages incurred as a direct result of their negligence in failing to clear hazardous debris from the roadway.

    Dunnet Bay is in receipt of the BBB report dated 11/03/2024 which references the 06/25/2024 Claim that Mr. ********** filed with the **************************************
    Dunnet Bays position of denial on this claim, remains. As referenced from our initial letter to claimant: There is no way to legitimize what exactly caused your damages; whether it truly was from our operations, or debris from a traveling public car/truck/trailer..etc. Your claim was thorough in nature, however, we cannot accept liability for an unknown hazard in the roadway within active lanes of traffic.
    When confronted with damage claims that are directly the result of Dunnet Bays actions or operations, we pay. That said, we cannot simply accept liability for anything that happens on the open road that happens to be near a work zone.
