    Nov. 14th 2021 contracted with ******************* of Fixx, LLC to build a deck. After several attempts to get ******************* to honor the contract he has not. He has repeatedly stated that he would show up to work on the deck, but he has not. Nor does he calls to inform me that he will not show. On August 5th, 2022 ******************* stated that if there was no work done by Monday August 8th, 2022, he would refund my money. He did not show or call. I am asking that *******************, Fixx LLC. refund monies that were paid to him for work not completed asap.

    I am not sure why I missed this email. I am definitely confused due to the fact we have communicated several times with ***************** after August 8th, 2022. We also have communicated with the deck material manufacturer as to some questions and we had an inspection after August 8th, 2022 as well, enlcosed is a copy of the email and the response.. As far as payment, previous to ***************** stopping the job, we had 12 man hours to go to complete the job, therefore, a balance is actually owed to us. I will submit our contract and payment schedule for your review. Hesitation as far as installation techniques arrised, hence the email to the manufacturer. I also ********** visited Mr. and ***************** and we were on te same page as far as the completion of the deck. Please review the info I have sent, as late as TODAY August 30th 2022 we recieved a response from the manufacturer. As far as the statements from *****************:

    1. We were honoring the contract.

    2. We did show up to work.

    3. We did communicate.

    4. We are actually owed a balance.

    I am rejecting this response because: It is not true.  On Monday August 22, ******************* agreed to meet to discuss workmanship issues with the deck. He did not show nor did he call. The next communication was a week later on August 29th when I was copied on an email to the manufacturer regarding the installation procedure. He told me he knew how to install composite decking. Today, the manufacturer confirmed that ************** did not install the deck correctly. For the last nine months of this project, I have endured broken promises time and again. We had enough! The work that was done was shoddy and not installed according to the manufacturer.  This voided the warranty. I now have to pay another contractor to undue ************** rushed shoddy workmanship.

    I am rejecting this response because: I am providing additional photos. However, the manufacturer already indicated that the deck was not installed properly. Please see photos attached. There is a letter from *************************/Trex dated August 31, 2022 which states that the boards should be installed with 1/8 inch gap to allow for room for expansion. There are also other issues which she outlines the installation. Because the manufacturers installation instructions were not followed, the warranty is voided.

    From Trex: End to End Gapping: Trex requires a 1/8 end-to-end gap when installing boards above 40 degrees Fahrenheit, and 3/16 when installing boards at temperatures below 40 degrees Fahrenheit. Gapping is necessary for natural expansion and contraction of composite material. Trex moves linearly when heated up, so if there is no gap between the ends of the boards, they will have nowhere to go but upward.  

    Butt Joints: The installation method for **** joints, where boards meet over a single joist, is to add a 2 x 4 nailer board at the **** joint. This allows each end of the board to have its own surface to rest upon, which is critical in preventing bowing and flaring of the deck boards. In addition, each board end should be fastened with at lea
    Overhang for the deck board application on the stairs, please refer to the attached 2022 Trex Decking Install Guide page #** to confirm that all overhang and gapping is per our recommendations.

    We are currently waiting for additional pictures from the customer so we can send them to the manufacturer. We installed the boards in accordance with the manufacturer recommendations. They need more pics to confirm this. They require a minimum of 1/8" spacing between the boards, due to the lack of clarity provided from the current pictures, it is not possible to determine the spacing size.
