      I signed a contract with Dale's Independent Contracting Services to renovate my attached garage on my home, including removal of an interior non-load bearing wall, cabinets and counter, installing new garage doors, repairing the ceiling and interior wall from where the other wall was removed, rebuilding the steps leading into the house from the garage, preparing and installing an epoxy coating on the garage floor and painting the walls and ceiling. The contract was signed on October 6th, 2022 with work scheduled to begin on November 7th, 2022 and be completed by November 18th, 2022. The total cost was to be $13,150.00 with a deposit of $6,575.00 due upon signing of the contract. He removed the wall, cabinets and counter, installed the garage doors improperly. He didn't finish the drywall. He has not rebuilt the steps, the painting of the walls and ceiling or the epoxy coating on the garage floor. I have had items including tools, etc. that was in my garage sitting outside under tarps since November of 2022. He left exposed wiring hanging out of the receptacles with no caps on. He has come to me seeking draws against his final bill which I have paid in good faith in the amounts of $3000.00 on December 16th, 2022 and $2000.00 on January 21st, 2023 leaving me owing him the remaining $1575.00. When I contacted him about why he wasn't completing the job, he stated that the temperature was too cold to apply the epoxy. He first stated that it would have to be in the 50's and then later stated no lower than the 60's at night for 3-4 nights consecutively to properly ensure adhesion and quality drying. His last response to me was a text message on May 26th, 2023 stating that he was working on a basement and he had to finish it. He said he would get back to me after labor day and never did. I sent him a message on June 2nd, 2023 and again on July 14th, 2023 and received no response. I want him to honor this contract and complete this job for which I have paid him.

      Signed a contract with Dales Independent Contracting on July 15th ***** to have remodel of my home done. Total price was $12,500, $6,250 deposit paid on July 15th, 2022 and remaining $6,250 to be paid once project was completed in full. Dales Independent Contracting was to start and finish project during the month of September 2022. Project was not started on time and project is still not complete. We have paid Dales Independent contracting $10,250 to date and myself and husband had to do over 50% of the work ourselves.I have included a detailed timeline of events of the project process, as well as pictures of what our home looked like on September 30th, 2022 which was the day the project was to be completed, and lastly pictures of what still needs to be completed in the attachments section of this complaint. I am looking to get back at least $2,000 to $3,000 of the $10,250 we have paid **** Independent Contracting, for reimbursement of the work myself and husband had to and still need to complete and materials that we still needed to purchase that were supposed to be provided by Dales Independent Contracting.Thank you,*********************

      They will not be getting anything back/ or off. Their detailed timeliness is missing the day they drove by their house at 10pm to see me in the window painting and they started to pull in but saw me and swerved. Also missing the day **** came by the house and I made a parts run and he relocked the door k*** not just the bolt. Also missing that the day the carpet installation happend the stairwell was going to happen 6 days later but they decided to do that while they were there. Just a few holes to show that they are making a timeline for their favor. The point here is **** called me intoxicated, slurring, and using profanity demanding that I was there the next day, after making a verbal agreement the prior Friday. Since I couldn't meet his demands has lead us to this point. They also have not taking into consideration the extra materials and time that they were not charged for nor in their bid. 350 feet of shoe mold had to be purchased and then installed to have their flooring and trim done properly with no gaps or lines. Since the carpet guys decided to do the stairs early I had to cover and protect white carpet on the stairs and also did every inch of new carpet with carpet shield. There were 13 doors that have 9 holes each that had to be glued and filled to secure the new door and hinge. None of these issues were they charged for. I even still offered to finish they job as long as I they would confirm i would be getting the rest of the final pay. At that point intoxicated **** slurred that my services would no longer be needed, and he was going after my BBB.

      I am rejecting this response because:

      The statements made in ************************ response are untrue. In response to those statements....

      -The day that ******************** stated we drove past our home at 10pm, we drove past around 7:30pm because we were at a near by event in downtown ********. I have two other witness that were in the car who can confirm the time was around 7:30pm not 10pm.

      -The day that ******************** stated **** dropped by the house was not accurate. I ********************* was the one that dropped by the house to see what work was being done, the bottom lock of the door was locked and I looked around and picked up some packages. I left and locked both locks on the front door since no one was there. I am not sure how that would have been an issue since ******************** had a key to our home. So is he saying he did not have a key? If not who did? Because I only gave a key to ********************.

      -To the carpet on the stairway being put in, yes I had it put in the same day has the bedrooms, since ******************** stated on the day of the installation he wasn't going to work because he didn't want to work around the carpet installers. So to not delay work another day I had the stairway carpet installed the same day as the bedrooms.

      -To **** calling him intoxicated, and slurring his words, this is completing untrue. He was not drink nor had he had anything to drink prior to his conversation with ********************. I did state the profanity was used because **** was frustrated that he wasn't getting a clear answer for **** and he was not telling the truth. Nor did **** state he was "going after" his BBB. **** stated he was going to make a complaint.

      -To the statement of having to buy 350 feet of shoe molding that was discussed when $1,250 was taken off the final payment because of the work **** and I had to do on our own for the home.

      -To the statement of having to buy and cover the stairway/bedroom carpet. If the painted has started like it was supposed to the carpet in the bedrooms wouldn't have needed to be covered. I will take accountability for the stairway having to be covered. 

      -To the statement of 13 doors with 9 hole each having to be filled, 5 of those 13 were not filled (2 in the master bathroom, 2 in the master bedroom, and 1 in the kitchen)

      - With the doors that were provided by **** they still has the film of the concrete sealer on them and **** had to spent a whole **** trying to clean it off and paint over. Some of the sealer he was still unable to get off. (I have provided pictures)

      -I would like to point our that ******************** never denied the dates that work was not completed on our home. A key to our home was given to him on September 14th, 2022 and was given back to us on October 4th, 2022. So in all ******************** had a key to our home for 20 days, in all 10 of those days ******************** worked on our home.

      -Lastly, **** did offer to complete the job but if he would receive his final payment of $1,000. Why would we want someone to continue work on our home, when they could not complete things when they say they would or not communicate with us on what was happening. We were never given an apology at all through this process which is the most upsetting part of this. What would have happened if we came back to our home with our two year old daughters and 2 dogs on October 1st, (************** told us we would be able to) with all of the work that still needed to be complete and the clear safety concern of no stair railings? Again no communication from ******************** or an apology.

      At the end of the day, if we don't get any money back fine, but I just want the complaint filled and this not to happen to anyone else.

      11/16/2022: Our industry has faced many challenges over the past year, we acted in good faith and worked on schedule the best we could. Our company agreed to complete the work, however the consumers were putting time demands on our company that could not be met. We will not offer any refunds. We are willing to void the contract and part ways.
