    I joined as a member of Smart Fit Method in May of 2024. In June, I reached a verbal agreement with the franchisee, ****** ****. The terms were that he could use my Live O2 adaptive contrast apparatus (concentrator and reservoir bag) with any of his clients using the Vasper fitness machine in exchange for me receiving a free membership. I dropped it off at the *** studio in Kildeer, ** in June and ****** set it up next to one of his two **************** From that time on, I used the O2 machine with the Vasper whenever I worked out at the studio 3-4 times a week. On 3/31/25, ****** sent an email message out to all members announcing that the studio was closed effective immediately. I then texted ****** on 4/3/24 asking when I could pick my O2 apparatus up from the studio and how he wanted to reconcile the two $300 *** free month gift certificates that I had purchased in December from *** and then gave to two friends as a Xmas gift. The certificates did not have an expiration date on them and none was communicated verbally at the time of purchase. ******** response to my request was that he couldn't do anything for me on either request because there was no money in the business account and that his understanding of our agreement was that once I let him use my ** apparatus that it effectively became a business asset for his *** franchise. We subsequently exchanged text messages over the following week concluding in me asking him for the name/contact info of the business attorney handling his *** franchise financial resolution so my attorney could contact his attorney in an effort to resolve this through appropriate legal channel. ****** responded by not providing his attorney's information and informing me that he has blocked my phone number on his phone because he feels I have been threatening him. The value of my apparatus new is $5,150. I have over $5,000 invested in the apparatus since I bought a new concentrator two years ago.
