    On August 18, 2022, I signed a contract with K&K Builders of Wonder Lake to have a deck built. ************************* is the contractor and owner of the company. The total cost of this project, according to the contract, was $7,925.00. The first payment to ************************* of $3,170.00 (40% of total) was to cover the purchase of all materials and lock in the start date. The second payment of $2,127.50 was paid on Sept. 9, 2022, after the framing inspection as was listed to be done in the contract. (A $500 credit, to be divided among the second and third payments, was given to us when ***** failed to contact ***** and hit an electrical cord.) Shortly after the second payment was made ***** stopped working on the deck and said if I wanted him to finish the deck I would have to pay for the materials to complete it. Since the first payment to ***** had been for him to purchase all the materials, I considered this request for additional funds a breach of contract. I asked him to send me a list of the materials he still needed and their price. ***** did not send it. I contacted the ******************* permit department. Their director and an inspector came out and found that their deck inspector had not noticed there were a number of code violations in the way the deck had been framed. A quote from a reputable deck builder listed the material costs to finish our deck as $2,750 and the labor costs to fix the code violations and finish the deck as $3,000. I would like to be refunded the cost of the materials that by contract ************************* was paid to buy but didn't. I would like to be refunded the cost of labor to fix the code violations and complete the deck as ***** was contractually obligated to do. I hope the BBB can help me obtain these funds from K&K Builders of Wonder Lake or from *************************, the owner and contractor. Attachments uploaded include the following: photos of 2 checks paid to *************************, a copy of the signed contract, and 2 photos of the unfinished deck. Thank you.
