    In April of this year, ***** ******, of KC's Custom Construction was contacted about the construction of a fence on our property at **** ** ******* ***** ** *******. ****** then provided an estimate for the completion of the work at $13,010.00. ***** then purchased the materials needed for the construction from *******. However, when a pallet of material was delivered, it was observed that the quality of the wood was poor. ***** agreed but stated that this was "all they had". *****, nevertheless, agreed to return the materials and repurchase quality fencing before proceeding forward with the project. To date, we have paid ***** two checks: one on April 24, 2024 for $6,500 to be used as a "down payment" and another for $6,407.05 for a total sum of $12,907.05. ***** has since abandoned this project but has absconded with the money and has left a pallet of unused wood in the driveway of the home. We have been advised by our attorney that this violates the Illinois Home Repair and Remodeling Act (815 ILCS 513/1 et seq.) We believe that we have a claim against Mr. ****** under the Consumer Fraud and Deceptive Business Practices Act (815 ILCS 501/1 et seq.) and we request to seek damages as well as attorney's fees and court costs.
