  Hello, I hired a contractor by the name of ************************* from All Natural Landscape Solutions to do a concrete project to redo my driveway and build retaining walls. The job was supposed to take a couple days, but it took a couple of months. The driveway looks fine, however the walls started cracking, had holes all over, streaks, masking tape left over, uneven cement and etc on the next day. ****** wanted the payment made in two parts, $6k at the beginning of the job and $3,200 at the completion. He started asking for the money way before the job was done, but I held off. Finally on 9/14 at night he said that the job was done, however it was too dark to see what the walls that were built looked like. Since he was adamant about getting his second payment, I wrote him the second check for $3,200 that night and he cashed it right away. The next morning I saw all of the issues with the walls. When I called him he started being really unresponsive and finally when I threatened him with legal action, he came over to look at the walls and said that for them to look the way they should I would have to pay an additional $600 which is not right. There was no agreement in our contract for cracked walls with holes and etc to be one price and if I wanted normal looking walls for a higher price. When the contract was signed and agreed and the permit obtained it was for proper walls. Since he stopped responding to me and wants extra money to finish the job, I would like to get at least my second payment back for this job as the way it looks now, the product is not complete and doesn't warrant that payment. If I cant get the second payment back, I would like for him to come back and finish the job at no additional cost. Thank you

  I am rejecting this response because:

  There was no confusion as mentioned by the contractor. **** from All Landscape Solutions called me and told me that ****** used ****** company name in order to get the license to do the work. **** and his company worked on certain parts of the project to help out ******. **** said during the call that in order to make this situation right and for me to drop my complaint with BBB, he would complete this job on ******'s behalf. He did mention that it is too late in the year to do concrete work, but said that sometime in May of next year he would personally complete the project. I told him, I will not accept, complete or cancel any complaint with BBB until he provides me with a contract/written agreement that the work will be done next May and that I won't have to pay for it.
