    On July 24th at approximately 10: 45 pm, I was driving, and my tire came off in the middle of a busy street. I was able to pull the car over and park it on a side street. My vehicle was out of the way, and parked legally. I tried getting it fixed that night, but Road Service told me that it was going to be about 2 hours before they could get to me, and it was getting late, so I said I will come first thing in the morning. I arrived that morning at approximately 8:00 am, and my truck was gone. I called around and found out it was impounded. I went to Chicago Auto Pound located at ***************************************************************** to retrieve my vehicle. When I paid the bill of $200, I also requested a hearing. Once that was done, I left to go to my truck. When I walked up to my vehicle and saw the damages, I was very upset. I went back into the building and asked for the supervisor. I showed him the damages to my vehicle before it was towed. My truck was badly damaged. The paint is scraped on the back drivers side, near the rear end, and it has a dent in it. The back bumper is damaged with a crack in it, and the passenger side door and back rear is also damaged with scrapes and scratches. They gave me a form to complete, and told me to go and get 3 estimates and submit them. I went and got the three estimates, and submitted them to United Road Towing, *** located at **********************************************************. While waiting on my results, I received my court date to attend court to request a refund for them impounding my truck for without cause. I attended court, and the judge agreed with me, and I was refunded the $200 for impoundment. Approximately 3 months later, I received a letter stating that they were not going to pay for damages. I filed an appeal, and I still have not heard from the company. This has been going on too long now, so I need some help getting this resolved. I am requesting that they pay me for the damages to my vehicle, and the money for towing.

    Our investigation, as substantiated by the type of towing equipment utilized, the vehicle inventory report and inspection noting damage to the vehicle, and questioning of the driver; we have concluded the alleged damage claimed was pre-existing and not the result of any action or negligence on the part of our company.  We deny any responsibility for the current condition of the vehicle.

    I am rejecting this response because:  I did not have these damages to my vehicle before my truck was towed.   By law, the company suppose to take pictures of a vehicle before it is towed.  I went to the establishment and asked them to provide me with pics they took of my vehicle before they towed it, and no one was able to produce them.  I believe they have them, but noticed that I did not have any of these damages on my vehicle prior to them towing it.  They damaged my vehicle, I provided them with the estimates they asked me to submit,  so they need to pay for damaging my vehicle.

    The law to which youve mentioned pertains to commercial relocation towing only.  Your vehicle was towed at the request of the City of ********  As previously mentioned, your vehicle was inspected and inventoried with damage.  We deny any responsibility for this claim.

    I am rejecting this response because:  I have pictures of my vehicle prior to it being towed showing none of these damages.  Prior to my vehicle being towed, I had a buyer that was interested in purchasing my vehicle, and the first thing he mentioned was how good the body was on my truck, so I will definitely get a statement from him as well.   When I went out to the pound/yard to retrieve my truck, I saw the damages and immediately brought it to their attention.  That's when my truck was observed for damages.   The damages that you all put there.  They filled out a form and told me to go and get three estimates, and that is what I did.  ************ damaged my vehicle, and you need to make it right!
