This complaint is being lodged against VAC All Pro Services for breach of contract and unacceptable workmanship. I signed his contract on 3/1/2023. Not only did this job take a very long time, but the end result was a major disappointment. Mr. ********* behavior was belligerent and threatening when his bullying behavior forced me to sign a check that exceeded the sign contract amount. I live alone and I am in my 70s and I had no other option but to pay him the extra money. I have him on tape as proof. The contract called for $5550. I was forced to pay $6940. I am still owed $1390 for the contracted work , the reason this has taken over a year is that I was waiting for the attorney general to do something more then sending two letters that were both ignored by this man. I also contacted a number of attorneys, but I was basically told this is too small. I also have a form that I filed with the ************************* regarding this, but they seem to just blow it off. I really would like to get that money back, but I dont want him doing this to anyone else. I have pictures of how my bathroom was left and I would love to send them.I could the job took much longer than stipulated in the contract on May 4 I asked ******************** to finish on the 9th and to update an itemize my receipt and contract. I was unable to decipher the contract at this point due to his scribblings. When I showed him my figures, he called me a liar, I then showed him the checks he had already cashed on my laptop, but he said the bank was also lying. I went outside, to get his worker to witness this craziness as I was becoming frightened at this point. I truly regret not calling the police at that time. I just wanted him to leave. I have everything I need to prove my case. Im quite disappointed at the fact that he was dismissed by the Attorney General. How can you get away with ignoring two letters? I guess when you have no rules you can do that. I hope to hear from you. Thank you so much.Initial Complaint

******* pro started work on my house after the pipes had broke, I originally signed a contract with him for a little over ********* with my insurance company. **** the owner keep finding things wrong in my house and submitting things to my insurance company for more money to the tune of over *********. My the process was the insurance company would send the checks and I would send them to the mortgage company and they would send them back to the contract. Once the work got started **** keep asking for more money this project started where we were out of our home from 2/9 by the time 5/9 **** was still not even half way done with the house for us to move in He demanded more more after he has already received over ******. my insurance along with my mortgage company refused to give him any money until the job was completed. He then halted the work making excuses everyday for coming to continue the work so once I contacted my insurance company and my mortgage company. I was instructed not to give him the last ******* dollar check that was sent and that I need to find another contactor. I requested that **** return all moneys paid to him for the remaining repairs that totaled over ********* this money included materials that he had not purchased. he refused. and now I am here trying to figure out what do I do next he has ran off with the money.Business Response

Im sorry to hear that you feel that I would keep money that does not belong to me. Im going to start from the beginning.
when we entered into this agreement it was between my ** and you . not your Mortgage **. and not the insurance **. I agreed to accept the money that the insurance ** Was giving you.
from the start I was working without Any money changing hands . the checks would **me in ok at first, because you where se**nd delaying them, then you stared to back off on that , even after I said I would pay for the delivering charges . after I was doing a lot of demoing in your house I found a lot of problems with your house. I was *** to show your insurance ** the problems and they agreed to take care of them. I did the repairs and waited one month to get paid. even though I was owed a lot of money for the past work, I still keep working on the house . ( the customer has home video proving I was there ). even after their insurance ** told me and the customer it was ok to replace the damaged plumbing . they said after 3 week went by they where not going to pay or the plumbing they said they where going to at first . even after that I still keep working there.( again customer has video of it). In the mean time I was busy customizing there two bathrooms I.E. removing soffits and doing custom plumbing along with installing a custom walk in tub that in their master bathroom. that tub took about one month to get installed. the customer order it around April 6 then cancelled it , then order it again which took over two weeks to get in. then they had to set up an electrician that took about a week, and he didn't put the box in the right spot so he had to **me back out , in the mean time the tub was broke and had to go back. being the nice guy that I am I didn't make the customer pay me to Carrey it back down a flight of stairs and re box it and drive it back to the store. then I re order it for them . that took another 2 1/2 weeks to get to the box store where I had to pick it back up and deliver it to there house . and set it up again and re install it . between all the delays from there Insurance ** and here Morgage ** and the and the customer . you where looking at almost 2 months . I had to eat that **st. not the customer.
when the Insurance ** was asking why its talking so long to get The house fixed the customer said she didn't know why. she just forgot to tell them that her walk-in tub took over one month to get in. and when the Mortgage ** asked her husband the same question she said he didn't know why either. I **nfronted both of them and said it's not fare to me that you both lied to the insurance ** and the mortgage **. so when the insurance ** called me I told them the truth about the delays . they where very disappointed that the home owners didn't not tell them the truth. I also talked to the mortgage ** , who was holding on to about 8k of the money for the house to get finished . they were no happy at all that the home owners with held this information. they said if they would have known about what was going on they **uld have helped released the money. but because of all the lies from the home owners they where not going to release Any of the close to 8k there holding on to.
they did tell me they send out a check for ******* for me . but when I asked the home owner she said she didn't know anything about it. and when the check came in she said that the mortgage ** said to send it back. ( it was not true she was ling to me like she was the insurance **. and the mortgage **.
Just for the re**rd I never told them I was not going to finish the project , I told them because there was a large amount of money owed to me and I was not going to be able to finish the project till I was make whole with the money that was owed to me for back pay. they where not happy that I was not going to put more of my own money into there house. being I was owed a lager amount . in the mean time there insurance ** was only giving them till may 22 and then they had to find there own hotel to stay in. and pay for it. so they came up with firing me and telling them I was not meeting there satisfaction with the time I was given. Keep in mind we never had a problem with anything before this .( And I have proof of this in text messages) in fact the mortgage ** sent a person out to check the house and talk pictures . and she asked the home owner some questions two of the questions where , how is your **ntractor doing , the customer said excellent , she also asked would you re**mmend them she said yes I would . this Was just before I called them out on there lies.
I have done nothing wrong, I am not holding on to any money that's there's . in fact they are holing on to over 7k of my money that's owed to me. I have a A+ rating with the BBB, this is an attempt to discredit me and my **. this **mplaint should be taken down asap. I have plenty of documentation proving me write .
I sent pictures of the plumbing that I switch out a picture of the joycess that needed to be replaced and the owner letting me know it's ok to install the tub.
Im just and honest person trying to make a living .

I am rejecting this response because: **** has continually lied about several things that he was doing. He has tried to manipulate not only myself and my insurance and mortgage company as well. After I signed the original contract with him, he went behind my back on several occasion to speak to my insurance company about more work that needed to be done on the property in order to request additional funds. He also made calls to my mortgage Company without informing me or asking my permission to see if this was okay. While I had nothing to hide he was clearly aware of the process of how monies was to be dispersed and the process along with the time line of how long it would take to receive funds for the project. **** called my insurance adjuster so many times that she begin to question the work that he was doing and how long it was taking. So they sent another adjuster out to verify the request that he was making. Everything that I am saying can be verified with my insurance and ***************** I am sending in the contract that I signed with ************* along with all the paperwork from my insurance company with how much they paid to **** from the start of this project up until the date that **** was questioned about the amount of work that he had done verses the amount of money that he was paid. My mortgage sent an inspector out because **** called them to ask for more funds that they were holding. Prior to **** informing me that he was not coming back to finish the work without more money. I had strong words with him about how long it was taking him to complete all work to my home.My insurance company never gave me a placement date of 5/22 from the hotel. This can all be verified that as of this date I am still at the hotel waiting on my house to be completed. **** was paid for things listed on the insurance estimate that he never completed and has not satisfied. I have copies of all check that **** was paid in the tune of around *********. I have paid ********* for a new contractor minus ******* given to me from the mortgage company to obtain a new contractor to complete the work. The only money that is left from my mortgage company is ******* for the carpet that **** was supposed to have installed. I have since then had the carpet install in amount of *******. **** keep money for several thing including all vanities, for the bathroom, mirrors lights fixtures, $5800.00 for the pack out of my house and other work that the new contractor had to correct that **** did in order for my house to become livable. Everything that I am saying can be proven by my insurance and mortgage company that encourage me to go after **** to retrieve money back from him because I hired him to do the work that he never completed in a timely manner.
Sincerely,

I disagree with what you just said, here's why..
when we first entered into the agreement, I told you I needed to have there permission in order to talk to here insurance *** the home owners said no problem do what you need to do to fix our house. I NEVER WENT BEHIND THERE BACKS THATS A LIE! they new everything that was going on with there house. also her insurance ** said from the start they have to run everything by the home owners before anything gets done. or any checks go out. they where so happy I was able to get all the extra work that the first adjuster missed form there insurance ***
Also never once did the insurance ** ask me any questions about how much money was payed (because they new already) and how much work was being done. her insurance ** was happy that I was not stopping the job site for nonpayment because they messed ** the first claim and had to start all over. that's why I'm so happy you where *** to send the 2 **pies of the claim,. there is a total of 3 **pies out there. they also new I was doing a good job because the home owner never **mplained about anything I was doing, and had nothing but good things to say about me and my *** and I can prove it with text messages.
the claim handler told me from there insurance ** they where only going to give them till May 22nd. that was the last extension they where going to give them. ( keep in mind the home owners delayed the job site about a month with there walk in tub) and keep asking me why the drywall was not hung ** in the family room,. and I had to keep reminding them we needed the plumbing done in the ceiling before the drywall **uld be installed. I also told them I needed to get the extra money the insurance owed me for services already done. this is just after we were texting about the vanitys. then I found out that the home owner decided to keep my money from the insurance *** and they made up a lie that the mortgage ** asked them to return the check to them. but the home owner just said that the mortgage ** told them to keep the check and find a new **ntractor. I hope you see what's going on her. here are some more things they left out. lets start with the Pack out , I told the customer from the start I was not going to move out there stuff, I was going to charge them to pack up some of there stuff, and the rest of the money will go back into there house it payed for a small part of the customization to there bathroom. we also had to redo the plumbing that the previous plumbing ** messed ** in there master bathroom. they left the **pper pipes above the floor so we where not able to install a vanity in there till that was fix. the home owners where so happy that I was able to do that. then there is the estaminets I sent to there insurance ** , because they asked me for them. the numbers on what you see is not what the insurance ** decided to pay out. in fact they just wanted to know what needed to be done and they would send the estaminet **sts based on there software (excatamate). Also the money that's owed to me is ******* ******* for the plumbing that just got approved, and was waiting one more pice of paperwork. and then there was about 5-7k that the insurance ** was getting reading to pay me for services I was doing . in total close to $18,000.00 still owed. plus the ******* the mortgage **mpany is holding on to. $ *********. I am not holding on to any money that is not owed to me. I put all the money the insurance ** gave me into the home.
Bottom line the customer told me they were very unhappy with the hotel room and the fact that they are in ******* and it takes them over 45 minutes to get to work . they started to take their frustration out on me, I reminded them that they delayed the job site about a month and the insurance ** new , and the mortgage ** new as well. that's when I think the insurance ** told them they had till May 22nd in the hotel room.
keep in mind before I told them I needed to get my back pay from the insurance ** before I **mplete the job site, never once did they say to the insurance ** i was doing a bad job. and the Mortgage ** **me out to inspect and asked the home owner two questions about my *** how are they doing ( she replied they are doing a great job)! She also asked would you re**mmend this **mpany,(the home owner said yes they wood. it's all in a document that the Mortgage ** has. I will try and request a **py of it.
I know the home owner can get a **py.
if you ask me they planned this, they new they only had till May 22 and that was **ming up fast. also they new the Mortgage ** now knows about all the delays and was not going to release the money to finish the house . so they cancelled my **ntract to by them more time other wise they would have to pay for a hotel room out of there pocket. Just think about it for se**nd , we only had to install 3 vanities ( that we where both looking at the two box stores and I can prove that) base board trim in the master bath. I had the light fixtures there and installed one of them . I was just getting ready to install the paneling in the family room, then the carpet .
we did a great job over there and do not deserve this slander. I Will fight this to the end.

I am rejecting this response because: The owner **** from ******* Pro has made it seem like, I along with my Insurance and **************** has repeatedly asked for a complete detail of all things that was done and need to be done to my property along with a detailed itemized listing of the cost of what he was spending monies on. My Claims adjustor can verify every word that I have said along with emails from me and the Contractor about all conversations during the horrible experience that I have had.
**** has repeatedly submitted request on just a blank piece of paper about funds that he needed to complete the process of my home, even after he had already received the labor fee and the cost of items he needed to purchase, again I paid for a tub to put in my house that never took a month to come. Again another lie that is being told by ****. I am still currently in my same hotel this can also be verified by my claims adjustor, and she can also verify that she never told **** nor myself that we were getting ready to be out on the street with no place to go, another lie.
I was asked not to put names and numbers on this portal, however everything from the ******* check that has been talked about from *********** can also be verified by my ***************** and **************** about what I was instructed to do after I received that check, all the problems that I and all parties involved has had with ************ and the way that he does business. When **** was told by myself that I didnt have the check in my procession. He then made up an excuse for him and his one worker being sick that neither of them was going to work that day. And that he needed to get that check and the ******* that my mortgage Company was holding until the work was finish.
In the mean time I still had walls not finished in my family room, and bathrooms. Painting that still needed to be done, doors needed to be hung, after all these months still pack out not completed, no carpet was installed. No Vanities or Mirrors were purchased. However all of these thing was on my estimate from my insurance company that was paid to ****, but none of these things were done or purchased.I have recently spoke to my insurance company again about the repairs of my home and was told that they paid ************ for everything that was needed to be done to my house for me to be able to begin living there again. ************ has keep money that is need to restore my house back and refuse to return the money that he is not entitled to.
************ represented himself as an upright honest person, all lies. He left me and my family with a **** financial burden by taking money that is needed to restore my home back to a livable state. I am applaud at a business that would do this to someone who trusted him to do what was right. I need the refund of money given to ************, by my ***************** to finish the repairs for my house.
Sincerely,
