    Restore was hired as a public adjuster to handle my claim on my home fire that occurred on September 23, 2021. We verbally agreed that they would waive their public adjuster fees if hired as contractors. Restore broke that agreement and charged us on our insurance payout for that service. On top of that, Restore and their Contract Manager ****************** has been nearly impossible to get hold of on regular bases. It has been 12 months since that set agreement, and my home is only about 30% built. They promise that I will have complete say on how my home house was to be made, yet I cannot get a hold of them.

    We understand that you are, or were, experiencing delays in the reconstruction of your home.

    You hired PM Adjusting LLC as your public adjuster to negotiate your insurance claim with **************** for the fire loss your property suffered September 23, 2021. Upon entering the repair contract with Restore Construction *** any adjusting fees related to the dwelling claim for this loss were waived and no funds were ever applied to a PA fee for negotiation of the building settlement.

    The delays for the rebuild of the property were due to the property being originally zoned for a commercial use property and not a residential property. This required that architectural drawings for the repairs needed to be completed for the ***************.  Restore Construction and the architect had to work tirelessly to get the property properly zoned for the repairs to obtain a building permit before repairs could begin. When you entered into a mutual agreement with Restore for repairs on your property in October 2021, you signed a contract that states; Contractor will secure all necessary permits and perform work in a timely, good and workmanlike manner, but is not responsible for delays beyond the contractors control such as inability to obtain permits, inclement weather, theft or vandalism, or owners delay. This is in the second paragraph of the contract that you signed.

    The team at Restore Construction including the construction manager, file manager, project manager and office staff have been in contact with you and your family throughout the process of repairs. These communications include phone calls, emails, text messages and in person meetings on multiple occasions.

    We feel as though the claims in your complaint regarding the fees being charged and communication problems are inaccurate. Restore Construction looks forward to continuing the repairs to your property to pre-loss condition with your familys assistance on finishes and material selections to ensure that you and your family are completely satisfied with the completed project.
