His roof was installed 13 years ago. I, along with the adjuster from his insurance company, went out to inspect the hail damage from the recent storms. The adjuster ended up giving him a check for the damage. The manufacturer requested that he send in the two shingles to check the damage. At one point, he requested for me to go on the roof to get the two shingles, however, he later requested that I don't do the service and to have no further contact with him. I've been trying to be helpful to him during this whole situation, but my services would be denied whenever they are offered. Upon request, I have proof of the communication between me and the consumer on this matter.

I have reviewed the business' response and am rejecting it because:

***** is the owner of JC Construction. The reason I told him not to come to my house I had already hired another contractor. Talking to him on the phone he said he did not tell me he would come to my house on a certain date. I could not get him out here. He used two different brands of shingles on my roof when he replaced it. I called ***** and ask him to look at my roof about 2 years after he replaced my roof, He never showed up. I did ask him for help after we had hail damage. He did come out at that time but never gave an explanation of why part of the roof looked great and part of the roof the shingle had almost no granules left on then. He had to know he was using two different brands of shingles. After dealing with the manufacture with out any help from *****. That is when I found out that he used two different brands of shingles. After he was told about the out come that I found out he used two different brands of shingles. I had no response from him. One brand was great, the other was junk.. ***** has my phone number and if he is willing to make it right, that would be great. I have reached out to him with no response at all . All I wanted is a fair and reasonable reimbursement. If he refuses I will continue to tring to resolve this issue . I hope he will understand. I have text messages as well as he does I also have pictures .

    Sincerely,

    ***** *****

This is a ridiculous claim. I dont understand why he thinks we used to different brands of shingles. ******* manufactures do not make the same color shingles. It would be no advantage to me to install two different brands of shingles and if I would have it would have been two different colors from the day I installed. I would like to see proof of these allegations but even so it wouldnt be a contractor issue. It would be a supplier issue. I order the amount of shingles we need and have them delivered. If two different brands showed up they would have been packaged in different colored bundles. This all just doesnt make sense to me. I went out there and gave him an estimate for his storm damage, the adjuster came out and gave him a check to replace the roof. After he told me he received a check for $26,000 from the insurance company he asked me to come out and install two new shingles so he could send two old ones in to try and get a warranty claim. I told him I would come out and do that. He called me the Friday before memorial weekend and was very upset with me because I hadnt been there yet. Asked me when I would be there. I told him Tuesday since it was a holiday weekend. I sent him a text message that Tuesday and told him I would be there around 4:30 or 5. He said dont come by. Didnt hear anything from him for a month and then received a threatening message at  4:41 in the morning saying I used two different brands of shingles and he was filing a consumer report and meeting with the attorney general. I will attach screenshots for proof.

I have reviewed the business' response and am rejecting it because:

In the attachment you can see the response from ***** and Corning stating that the samples taken from my roof were not there's

The samples from my roof were sent to **** and Corning that is how I found out that two different manufactures of shingles were used. The shingles that were in good shape were ***** and Corning the shingles that were bad was manufactured by ************. ***** did come out to look at my roof after the hail storm. He stated that there was a problem with the shingles. If he would just own up to this problem it wound be a issue . I NEVER received a check for $26,000 from my insurance. My insurans charged me $5,026.00 because of the shingle. At first they were not going to cover it at all. Because of the Tamko Dallas shingle being used along with ***** and Corning I feel ***** should reimburse me the $5,026.00 and he can take it up with Tamko Dallas. I didn't know anything about shingle that why I ask ***** for his help. Yes he should some texts but there were phone call in between some of the texts. If a business owner says he will be there or help you then he should. I used ***** in the past on different jobs. Everything went great. But this time I don't know what happend . I will try and post some pics , of may have to get some help on that. I don't know if ***** was even here when the shingles were put on, I think He runs a crew and someone else runs a crew. He may have not known about the two different manufactures but he should be held responsible and take ownership of this problem. Thank You

    Sincerely,

You can definitely see the different shingles in the pics. I don't want to put JC Construction down but right is right. I hope the new pics and the letter from ***** and Corning clears up any misunderstandings. When emotions are running high things get said in a harsh way. I apologize for my attitude but I believe JC Construction ***** this problem and has the ability to deal with Tamko Dallas. I know it's been around 13 years ago but I also called ***** about two years after the roof was put on about the amount of granules in the gutters. He responded saying that's from just being a new roof. Please lets get this resolved. Thank You, ***** Cluck

The one pic shows the tape that came off a ***** and Corning shingle. I think it's pretty evident just by looking at the pics that there two different manufactures and colors. The one's from Tamko Dallas are defiantly defective. If I buy a car from a dealership and there is a problem, the dealership goes to the manufacturer to solve the issue not the me the consumer . I look at this the same way. There is a problem with the shingles from Tamko Dallas not to mention that ***** and Corning was used as well . I am the consumer, JC Construction is the supplier, he can take it to where ever he bought them from and they can hammer it out. I shouldn't be involved at all. At least that is how I see it. I hope this puts some clarity on this.  Thank You , ***** Cluck
