I received a proposal (quote #152) from Jamie on 4/28/21 to paint the exterior of my home. I accepted the quote but Jamie was unable to get to the project that year before the weather got too cold; so during the winter months I asked if he would like to quote some of my interior jobs. He did. On 2/9/22 I received a proposal (quote #172) for work in my pantry, kitchen, and living room. I decided to move forward with the pantry which was quoted at $380 + materials. The final invoice (labor and materials) came to $367.47 dated 2/22/22 which I paid with check #7381 and mailed on 2/28/22. He then texted me on 3/28/22 and said he could do the living room the following week and at that time I texted him about an area in the pantry that was not completed as we discussed and he verbally told me he'd repair it and has never done so to-date. The Living room (quoted at $660 and invoiced $727.71 which I paid even though there are several missed spots there but decided to be kind and "overlook" them. He then worked on the kitchen, bathroom, and laundry room quoted at total $1990 but invoice and I paid $3715.82 ($2436.44 which was for a tiny bathroom and a small laundry room), The ceiling in the bathroom still has a hole in it that he refuses to come and fix, there is a crack in the laundry room wall, there is bubbling paint in the bathroom, there is no trim in the bathroom, laundry, or kitchen but I paid for it to be painted? I have tried to get him to come look at and correct the pantry and bathroom areas with no luck - there are issues in the living room and laundry too. Then he painted the exterior of my home and it is not completed but he is demanding full payment of the job even though he cannot finish it until spring. He refuses to provide a punch list to me so we are all on the same page of what needs done to complete the project. He painted areas that should not have been so he wanted to bid the job to complete that work too. I am out of space but more remains.Business Response

This is nothing more than a feeble ploy to scam her way out of paying for services provided that is 99% complete and to try to discredit me and my livelihood. I take great pride in my work and strive for complete customer satisfaction.
There is only 10-15 minutes worth of touch ups left to complete the exterior job that has not been able to be completed due to freezing temperatures. I explained this several times and have also tried several times to set the appointment as weather permits. I contacted her (see screenshots) to set a time based on the temperatures as they changed daily but she advised she needed more notice. She has to be more flexible with daily weather changes to get this completed. She refused to set the paint outside needed for the touch ups and she advised now I was no longer allowed on her property unless she was going to be home. My attempts to resolve this particular issue have been refused by *****. I believe she is purposefully refusing to let me fix the remaining issues so she can avoid paying me.
I can not wait until Spring for payment of services I have provided. The other interior issues she brought up have absolutely nothing to do with the exterior job and payment. I previously told her once payment had been received for the exterior work i have completed as she promised on November 13th, I would receive just as soon as she transferred funds, (which should have been next day), I would be glad to come back and address the interior issues.
Seems like things took a turn and I have gotten nothing but arguments, accusations, been called “a crook, a cheat and a liar”,”I don’t know how to do my job,” “I used the wrong products,” and it just goes on ever since the day I asked politely to clean up her dog’s feces out of the back yard where I was working having stepped in it the day before. She told me the 1st time I had to ask her to pick it up that her people she hired to pick up dog waste come once a week and that I should keep her posted which is not my responsibility! She then told me they were on vacation this week and would not be there. So when she came home that day around 3:30 advised me she wouldn’t have time to do it herself because she had to be somewhere at 5:30. When I responded “oh, ok” she said I was upset with her and started to raise her voice and said “You should watch where you are walking.”. After I explained why I couldn’t watch my every step while I’m going up and down a ladder all across the house, she slammed her door as hard as she could, came back out with her 20 year old son who was home all day and proceeded to stand right in front of me and in my personal space in a threatening manner. She asked if I was leaving and I advised no, she then asked if I was getting paint on her rug and I advised no it was paint chips from peeling old paint. She then yells “You have a fucking attitude with me right now and you better knock it off.”. I tried to walk away from them both while she was still yelling @ me. They left and then came back a few minutes later slamming the door several times going in and out. Her son then went and raked the yard for me after trying to calm his mother down. I had every right to walk away and not return at that point, but I didn’t. The largest of the touch up areas needing done is a 1X3 area that is in the area next to the fence gate which I probably would not have missed had all this yelling and screaming at me had not have happened. I have never left anything unfinished and have never had any complaints. There are no large areas undone as she claims.
As for the interior issues: She also claims there were areas missed in the living room which was done months prior which is not true. She had never said anything to me prior about areas in the living room. The laundry room and bathroom were combined in the same price on the invoice. The laundry room had paneling on the walls that she asked me to remove (which was not included in the estimate.) Pulled nails, fixed, replaced and repaired the walls underneath paneling and fixed ceiling around walls and textured ceiling. None of this was included in estimate.
The issues in the bathroom are from excessive moisture from showering. This is due to her not replacing the fan soon after I painted. There were no issues with my painting of the bathroom. The ceiling fan was not installed by a professional contractor(she advised). It was hanging down out of the ceiling and was not vented out to the exterior of the home. I had to clean the walls of buildup from soap scum to be able to prime. All of this not on estimate and is something she could have done to lower charges. She then asked me to remove the fan. She asked me to install a light with no fan. I refused as I am not a Certified Electrician and I recommended that a new fan be installed properly and vented outside. I did put some insulation and plastic in the open hole to help prevent moisture from going into the open space above the ceiling on 5/13/22. I did not repair the hole and did not charge her to repair the hole. She did not have a fan installed until 8/6/22 and whoever did that removed the insulation from the hole. That is a long period of time that moisture can get trapped in that room. The lack of a working fan and subsequent issues caused by lack of fan are not my responsibility. On 11/13/22 she stated there is still no insulation which is not my responsibility.
I have never had to provide a customer with a punch list. I had previously met her at her house and she showed me each exterior area she had concerns with on 11/13/22. therefore, no need for a list.
I normally charge $45 an hour for exterior jobs. I only charged ***** $40 an hour and gave her my discounted prices on materials. I proposed removing 11 hours of labor to resolve our dispute which would have been a savings of $1267.00.
I gave her as close of an estimation of material costs that was subject to change with additional work requested. Material costs have gone up for everything in the past two years of which I do not have control.
I only did work she requested. She said she would paint the shutters but that was never done so I discussed that I could take them to my shop and get them done if she wanted. She responded “Yeah, ok” because she was running out of time. I took them to my shop that evening and text her the very next morning to confirm she wanted all 22 shutters painted in which she responded “yes.”. (see screenshots)Customer Answer

I am rejecting this response because:
It is absolutely disheartening to see a business owner write so many blatant lies and inaccurate information in a response. I refuse to continue to argue via this platform with Jamie as I have pictures, video, and text proof to support my claims and to refute most everything he wrote in his response. His response further shows his true character.
I do notice in his response that he states: “I proposed removing 11 hours of labor to resolve our dispute which would have been a savings of $1267.00” - this is another lie as this was never proposed to me. To move things along, I will accept the $1267.00 savings so we can resolve this matter as I do not wish to continue dealing with an unprofessional business owner who is lying and refuses to address completing or correcting his much less than professional work. With the labor and material corrections and application of the discount the balance owed is $1980.51.
Today I prepared check number #7409 in the amount of $1980.51 to pay invoice 108374 in full so we may close this issue. Once Jamie Rose Painting accepts this offer then I will promptly send check #7409 for $1980.51 via certified USPS mail to satisfy Invoice #108374. If Jamie Rose chooses not to accept this offer then he can begin court proceedings where all interior and exterior issues can be addressed and resolved. Thank you.

I find many issues with *** ********* complaint, namely that I did not provide the services she requested.
I feel she is attempting to discredit me & my business to avoid paying for the services provided.
The Interior issues (beyond my control & not my responsibility) have absolutely nothing to do with the Exterior Invoice #****** that is outstanding. I repeatedly tried to go back & do the 10 minutes' worth of touch-ups, but she refused to let me finish the job each time.
*** ******* owes me a payment of $4,753.39, which is now over 30 days past due. (See Invoice #******.) She previously promised to pay me on November 13, 2022, in the form of a Cashier’s Check(she indicated it would be sent “just as soon as she transferred funds,” which should have been the next day. )
I let *** ******* know that the discount of removing $1,267.00 from the total was conditional upon prompt payment to settle all of our issues fully.
I have not and will not agree to a complete resolution of $1,980.00, as that would barely
cover the expense of the materials I gave her at my cost (instead of what she would have had to pay and what any other contractor would have charged her.)
My final offer of resolution is the payment of $4,713.39 (This is the total amount she owes me minus one hour of my work at $40/hour to make up for the unfinished touch-ups(which is generous as I believe it would take no more than 10 minutes and she refuses to let me complete. This offer includes a reduction on top of the previous 11 hours of labor that I already subtracted from the original Invoice, plus discounted materials. The offers for reduced amounts are still conditional upon full and final prompt payment by *** ********
If *** ******* does not wish to fully and finally pay this amount, I will seek full payment for all services rendered.
I am an honest and hardworking individual who takes personal offense to the accusations that *** ******* has complained of. I have hundreds of other customers who are content to receive my services at a total price.
My work speaks for itself; the invoices are for the work done, and her sole reason for refusing to let me on the property is that she will have to pay the total price.
I want a resolution and to be paid for the work I did for her. The text messages supplied accurately reflect that *** ****** knew the work I was doing (as it was work she requested), and she did not have any issues with my work until it came time for her to pay. I am rejecting this response because:
Again, I refuse to respond to the blatant lies and inaccuracies from the business that are in their first response and also in the most recent response. Since the business owner refuses to be honest and actually open to the idea of a resolution for the unfinished exterior work and the many interior issues that have been brought to his attention MANY times (since March 2022 to current date) then it would be best for him to seek resolution in another way such as a court of law.
I thought by seeking a fair and honest resolution attempt through the BBB to get the unfinished work completed and also by proposing to make an offer for payment of my check ***** that we could close this matter quickly but, sadly, that does not appear so.
In his most recent response he states: "My work speaks for itself" and I fully agree. Please review the pictures that I sent with my initial complaint. They represent only a few of the many pictures/issues of his work at my home but they do speak volumes.
