  My roof is leaking, and it is raining in my bedroom. I have attempted to contact the company several times to rectify the concern, but I have been ignored. This roof was just replaced in 2019, and it is expected to last at least 15 years.

  Magdan construction half did work and left. They never finished work in my home. In 2021 someone damaged my property, and I was referred to Magdan. The insurance company came out and inspected and cut a check. After receiving the check I was told by *********************** that I needed to sign over the check to him and not my mortgage company. Against my better judgement I signed over the check and less than a hour later I was told that I shouldnt have done that. I requested the check be returned and was denied. I was given ***** to hold until the work was complete to ensure the work was done right. 2 months had gone by and the only thing that was done was my basement cleaned out and items put in storage (some by the contractors and some by myself) and they painted the walls and pulled up carpet from the 1st floor. After 2 months of being in a hotel and countless unreturned calls from *********************** about meeting that he never showed up for nor did he call to change the date I asked for another ***** (total now *****) back to hold. After that some work was done on my home but the home still wasnt livable. I was told that the plumbing was fixed and that I could wash my clothes only to have water coming from pipes in the ceiling had several items damaged from water. They submitted a list of items to myself and the insurance company for work they completed but the list is inaccurate. They have at least 1 room listed with work that they did but there is no such room in my home. Several items were damaged during their time in my home and they tried to tell me they didnt do it it came from the accident. They claim my plumbing issue did not come from them and that they did no real work in the basement of my home but I have had several other contractors come in to give estimates and they all show me a new copper pipe and sheet metal connected to my hvac that are new. I never had plumbing issues with my home before (I purchased in 2018 and everything was up to date and code)I also have an issue with the clothing items that Magdan construction sent to the cleaners (urban air) I had a coat with lamb skin that was not water damaged come back from the cleaners destroyer (hard as a brick) because that coat shouldnt have been washers with water I believe. And as far as the list of my personal property submitted to Allstate on my behalf it was submittedit had no detail and was missing several items. I have tried several ways to contact Magdan (***********************) to justfix the work that thedy did and any work that needs to be done othedr tha that will be done by another contractor.

  In regards to the complaint, Magdan Construction *** completed work per the Insurance settlement. ********** received funds of $7,000.00 directly from Magdan Construction. An additional payment of $7,345.34 is being held in depreciation. We have relayed to ********** that once she returns the payment of $7,000.00 any remaining work would be completed that was included in the insurance settlement. ********** has refused to do this as well as state she would not release the depreciation once work is completed. Unfortunately, Magdan Construction, ***, can not continue with any work if the homeowner refuses to reimburse for the work completed. 

  Any damages that ************ states she suffered as a result of the claim that are outside of the approved settlement should be brought to the attention to her insurance claim adjuster. As for the personal items claimed to be damaged due to the accident, should also be brought to the attention of the insurance adjuster so a total loss can be determined, through appraisals and proof of purchase.

  I am rejecting this response because: the things they are saying should go though insurance were denied because the insurance company called Magdan construction and they denied the items. Since they improperly submitted the personal property items and I had to go back and fix I was denied the missing items. The insurance company had a hearing 09/01/2022 and I was told by their legal team that magdan construction not only claimed I did not have items that were listed but that I did not have other items in storage on my own which I have proof I did until my personal property adjuster told me nobody needed to view items. I do not feel comfortable giving the money (*****) because the work that has already been done isnt done properly. I only would like them to fix the work that was done and already paid for by insurance according to the list Magdan provided to myself and insurance company.

  In response to Ms. **** complaint response. Unfortunately, we as Contractors do not have any say or control of what the insurance pays for when it comes to the personal property of an insured. We are only responsible for the any repairs approved by the Insurance.

  I am rejecting this response because: i do not believe Allstate should be paying for damages done by contractor. I keep asking for the work to be fixed in which they were already paid for not the work that was not done because of the 7,000being taken back. ***** was returned to ensure they did not run off after doing half the work( which they still did) and the ***** was from them telling me the plumbing was fixed and that I could wash and items were destroyed in the basement. Allstate isnt liable to fix their mistakes MAGDAN is. I have proof (photos and videos) showing proof of the condition of my home before, during, and after Magdan came into my home they damaged my property and are trying their best not to compensate for their wrong doing.
