    Maggio's towed a semi on March 5, 2024 from the Petro in ********. They have a Missouri plate on the bill, and also sent a letter to the registered owner in ********. This would lead me to believe they did a lien search in ********. However, they did not notify the lien holder of the truck being stored and give the lien holder the same opportunity to recovery the vehicle. Instead they sat on it and accrued storage and when we learned from an associate of the R/O that the truck was there, then they sent us this astronomical invoice for storage. This is Maggio's response when I request documentation they notified the lien holder by mail: We followed all of the statutes in regards to supplying notice for the vehicle being at our facility. The vehicle will continue to accrue storage at $140.00 per calendar day, you will have until the end of the week and we will begin the title process to obtain title to dispose of vehicle." Yet they do not send me any documentation and do not respond to phone calls.

    In regards to the complaint filed, we did follow the statutes of the law in regards to notification.  You can see from the paper she sent that we did a search of lien holder and the paperwork received back from the state shows there is no Lien Holder. We sent applicable notice to the owner of the vehicle which she also sent to you.  The file she sent to you in regards to the Missouri ********************* states at the top of the page that it is an application for lienholder from 2021- that is strictly an application that was typed out and does not state there is a lien to the vehicle.  I have also attached the email chain showing she contacted multiple police agencies, state agencies and mayors for the cities and was told that there was no wrong doing.  We feel that she is making the complaint because she wasn't able to get the response she wanted to be able to get her invoice discounted.  We did exactly as we are required by the state of Illinois in regards to vehicle owner/lien holder notification. Again I have included the email chain for you to see no wrong doing on our part.

    I am rejecting this response because:  The business knew there was a registered owner in ******** and did not bother to check for a lien holder in ******** and it is the tow company's responsibility to check for the lien holder in other states besides the state they are located in per Illinois state law.  In ******** as all other states an application for a lien is solid evidence there is a lien on file with that state filed by the lien holder to protect their rights.  It is the tow company's responsibility to notify the lienholder or waive the storage if they fail to do so, this is Illinois state statue as well.  The state ***************** has accepted my complaint and we will see how their investigation goes, and I will report it back to the BBB.  Thank you,

    We are still standing on our original position. We did everything that was required by the law, we showed the proof that no lien holder was listed and notice was sent to the registered owner.  We feel she is trying to purse a refund to maximize the profit she is making from the lien holder.  She is not the lien holder, she is the skip tracer that is hired to find the vehicles for the lien holder. If there had been an issue we had advised that the lien holder could contact us which they did not.  Also the emails I previously attached show the response that the *** gave her and it did not state any wrongdoings on our part.
