On the date of 8/2/20 I was arrested on private property by untrained police officers making claims that I was under the influence because they alleged to smell alcohol on my breath with particle mask on, also alleging to see intoxication in my eyes through what the judge had determined was a faulty hgn, and although no other test were taken and no BAC provided or admission of drinking anything alcoholic I was arrested regardless. In an attempt to resolve this matter hired attorney Joshua Smith to represent me. Regardless of keeping him updated in the matter he failed to file his motion to suppress in a timely manner while excluding relevant facts such as the lack of BAC or lack of admission of drinking anything alcoholic among other things. Also for the majority of our communications wouldn't respond or give me the appropriate advice needed. In conjunction has allowed prosecutor's to proceed on a fraudulent affidavit signed by someone not required to come to court and to tamper with evidence while not reporting them for doing so. As of recently I have tried to obtain my court documents from him on several occasions so I may properly represent myself and have only received paperwork I've sent him along with court docket information but nothing of the request for the discovery given to him by the state in accordance with Rule 1.16(d) Rule **** (a. So unable to represent myself without such paperwork need this from him. So in the attachments below have included documents that he has handled and that I would like to obtain along with everything else required by law. If you could please get back to me it would be appreciated. Thank you!

    Business Response

There is nothing, absolutely nothing, that the law requires me to do that I have not already done for him. I have been cleared by the **** already of his meritless complaints of malfeasance, so perhaps you should look at that.

    Complaint: 19517616

I am rejecting this response because:

In rebuttal to the Law Office of Joshua Smith considering I was unsure how to proceed in my redaction of the withdrawal for an unresolved complaint Joshua Smith was never investigated by the **** as it did not exceed past the initial intake process and considering I was unfamiliar on how to file my grievance as in this process nothing was ever resolved. In conjunction have yet to receive my documents from Joshua Smith obtained in the discovery process or unearned fees. So if he's asking me to look at something that he was cleared of is irrelevant considering it was never investigated and my grievance unresolved in right standing in attempt to resolve my issues to represent myself correctly. So if you could please redact my withdrawal in this matter and convey this to him would have greatly appreciated. Thank you for your time

    Sincerely,
