Hello Better Business Bureau, It has been brought up to my attention that ******************* has filled a complaint against my company. I would like to dispute the accusations he has stated in his complaint. First of all I would like to state that ******************* has stated in his Negative complaint that he has contacted us multiple times and we have been avoiding him, Which those accusations are not true. **** has only contacted us 3 times, One has been via email on November 7th and we had agreed to meet at the location on November 21st After many attempts of us reminding him, he decided not to give us importance by never answering the phone. I would like to point out that any company would have voided his warranty instantly after failing to let them do the touch-**** The second has been on the phone. I have stated to him that there is a process to complete the touch **** Which is he has to contact me first, After that I have to contact my ******************************* Representative and we have to schedule a meeting at the clients house to get approved. After all that has been completed we have to send a worker to his house to do the touch up in the area that has to be fixed. I Stated the process to **** and I told him to give me some time arrange a meeting as well as to with for the weather to get better since it was still March and I didn't want the weather to cause damage once again. He later called again in middle of April stating that if didn't go that day he would burn me all over social media and make my company shut down. I tried to explain to him that I would decently honor my work but he kept on saying he was going to burn me all over social media and that he knew people that would take my license away. We eventually agreed that I was going to do the touch-*** as soon as possible. The next day he wrote very bad negative reviews on my social media which were not true. He also sated that the painting my workers performed were "average at best" which I don't know why he would say that if after we were done with the exterior he actually asked me to give him another estimate in the interior of his home. you can defiantly see that all his reviews on my ****** and yelp were made with different names and not under his name to cause more damage.

I ask the Better Business Bureau to please side with us and to not approve this complaint. I have worked very hard to have a perfect score on my BBB profile to have someone destroy it after them being disrespectful to my crew, myself, and my company. I would have loved to do his touch-*** but I can't drop all of the work I have for a person who decided to never open his door when we already had an appointment scheduled 2 weeks before. I would also like to add that this whole year we had only 2 warranty touch *** and all have been done, Approved, And completed. I ask the Better Business Bureau to please call them and ask if they have any complaints of us. I have attached a screenshot of the messages as well as phone number and address of the clients in order for the BBB to contact them and see for them selfs that we would never do something like ******************* is accusing us of. I have also attached the phone number of My ******************************* Representative to call and ask the process of a warranty.

I am rejecting this response because:

    Better Business Bureau-

I have taken the time to review Live Paintings response.  The interactions I have had recently with Live Painting and warranty work have been unfortunate and there are quite a few inaccuracies to their response to the BBB.

I contacted Live Painting in November and Live Painting did schedule a touch *** based on warranty for Nov 21st.   I contacted ******* (owner) and he stated it was too cold out to complete the touch *** (low temp 29 degrees) and he would handle in the Spring.  In the Spring, I contacted Live Painting numerous times in order to have the touch *** completed and every response from them was they were busy and they would contact me later to schedule the touch ***.  I let them know that it is their legal obligation to honor a warranty and they stated they will.   I called them again a couple weeks later and Live Paintings response was the same, saying they will schedule it another time with no approximate date given.  I told them I will be leaving reviews on social media regarding the failure to honor their own warranty.  Their response was go ahead.  At no time did I ever make a statement saying I would get their license taken away.  I am not even sure what license they are referring to.  I did leave the same negative review on multiple web pages stating:

Painting is average at best.  1 Star given due to trying to get someone out for warranty work.  I understand it is their busy exterior painting business but Live Paintings response is we are busy and will let you know when we can come out even after a month of waiting.  If things were painted properly and not in a hurry to get the job completed, we probably wouldn't have had to even discuss warranty work.

I would consider adjusting my review if I can get ******* (Live Painting) to honor the warranty.  Sad you have to resort to online reviews.

After I left this review, I called back a few weeks later regarding them scheduling the warranty work and they said they will not honor the warranty.  This warranty is their legal obligation and this is why I have had to get the BBB involved.  My next steps in this matter will be filing a small claims civil case with Will County for restitution if this is not resolved.

    Sincerely,

    *******************

To the BBB and *******************, although we don't agree with the allegations of *******************, we would like to end this dispute as soon as possible. Our time is very valuable to be going to court although we are not wrong in any way, we rather keep working rather than waste our time.
We would like to offer one last opportunity to ******************* to complete our part of the warranty on exactly Monday August 28th of 2023 at 8:00 AM . But there will be some requests on our side.
    1. The only touch-*** that will be done are the ones that ******************* and I previously walked and approved, that i will instruct my employee.
2.******************* will provide the paint. If paint runs out ******************* will be responsible to provide more. ******************* decided to rush things and we couldn't handle the warranty in timely manner. Our ******************************* representative will not reimburse us for any expense. Otherwise, all expenses could have been covered by them.
    3. ******************* stated that he would "CHANGE" his reviews, but we are not requesting that. We request that after we complete all touch-*** ******************* DELETES all his bad reviews. All of his reviews were untruthful, and we stand by it. If he fails to remove them, we will bill him for touch ***.

This could have been handled in such an easy way if things wouldn't have escalated. If this claim gets rejected, we are prepared to go to court.
