    I enter a contract with the company crack attack team now crack attack concrete located in *********** on July 29, 2023. *** the owner of the company submitted and estimate for replacing the foundation of my house. I agreed to the price and a contract was signed. A deposit of ********* was given on September 5, 2023. After many contacts with the company manager, with *** the owner and the county. I found out that the company had not submitted the required documents for permits to be approved. Winter came and I was told by *** that my project would be the first job his company would do as soon as the weather broke. Around March ****** I received a notification from crack attack team that they would not be able to proceed with the project and included a partial deposit of *********. He stated that the I would received the remaining funds within 90 days, the reason for partial refund, manufacturer return material would take up to 90 days. After many attempts at getting an answer about the remaining balance and the company or *** not receiving and ignoring my phone calls I am submitting my complaint to see if a can get the remaining 7, ****** that the company **** me since they never perform any work on my property.

    Yes, the client did enter a contract contract with our company. After multiple attempts to achieve permitting and proper engineering, we were not able to achieve the proper permits. Materials were purchased for the project, and the client was aware that these portions of the project were nonrefundable. there was also cost of engineering that was not refundable for this project. These portions of the project were completed and paid with the deposit. We are happy to Resupply the client and or the suitable party of the necessary documents.

    I am rejecting this response because:
       Regardless of what Mr *** ********** from Crack Attack Team states, I was not told  verbally or in writing that if the project was not completed for any reason other than my own decision I would loose my deposit. Per the contract, if after 72 hours of my deposit I changed my mind  20% of my deposit would be non refundable. I did not cancelled the contract. Per the statement I received around March 5, 2024 I received a partial refund of my deposit and I would receive the remaining funds within 90 days. I dont believe that *** should keep ******** when no work was done on my property. I have retained legal counsel but Mr ********** is a hard person to find. 
    I will appreciate any type of help that your department can provide.
