    On July 21, I hired ***'s Landscaping to clean my gutters. The owner came out and informed me that I had gutter guards but cleaned a lot of debris from my roof. I paid him our agreed upon amount of $100.00 While he was there he told me he does a lot of different types of work and so I showed him a problem I was having with some siding and a **** I wanted cut down. He said he could do that work and we agreed upon an additional 100 to do that work or a total of $200. He said he could complete the second part of the work by July ******************************************************************** less and it was only an additional 100, I paid him for everything on July 21. l commented that I don't normally pay for work before it is done but he seemed like a trustworthy individual and had met the original commitment as agreed. On July 28th I sent him a text to ask if he was coming since we had agreed to that date. On july 29, he sent a text back to say that one of his jobs had taken longer than he thought but that he would be to my place. On same day I responded to ask if he could give me a new date. On July 31, I got a text from him saying he would see me the morning of August 1. He did not show or contact me. I sent him a text on August 2 saying that he seemed too busy to do my job so if he couldn't fit me in, he could just ***** the 100 back to me. He responded "ok, that's fine no problem. On August 3, I let him know that I did not receive the money and that if I did not receive it by August 4, I was going to refer the matter to you and that is what I am doing.
