They installed a deck on the back of my house and while they were working on the deck they damaged siding on my house. Mike Harris promised over and over again that he would come by or one of his workers to replace the siding. I paid him for the work and the siding to replace the damaged siding but no one has come over to repair the damage.Initial Complaint

Harris Fence Co installed a fence for us in Dec of 2023. At the time of installation, the owner told me he would be back to adjust the gate since it did not open fully due to hanging too low. In the subsequent few months, many boards began significantly warping, to which he also replied that he would replace / repair those. That was in April 2024.
In the 16 months since the fence was put up, I’ve contacted him via text no less than 12 times to inquire about the repairs. Multiple times I’ve been given a time frame in which they would be back to make repairs. Now I text him and he will read the message but not reply at all. I’m not seeking any money back or anything. I would just like the fence to be repaired.Initial Complaint

We paid deposit of $5,943.42 which posted April 19, 2024. We were dealing with ***** ***** who worked with **** Harris at Harris Fence Co and thus communicated through him. On May 6 Mr. ***** indicated they were hoping to get started in the "next few weeks". I texted June 10 and heard back June 18 that they were 3 weeks out then. On July 5 I texted again to be told we were still on schedule for fence to start on July 15. When Mr. ***** would no longer respond I found Mr. Harris phone # and contacted him on July 18 and was told "for sure within the next two weeks." Aug 12 I asked Mr. Harris to call me but he said he was on phone with ***** to get our yard marked. On Aug 15 I asked when they would be starting and he said they would be at our job the following week. Aug 19 I texted him again and asked him to call me but he texted and said they would be starting the job by Aug 30. Aug 20 after a few other texts he called me and he had many excuses as to why they were so behind. I believed in him. Aug 28 I texted and asked if fence still going up on 30th. He said either Friday (the 30th) or that following Monday. Monday was a holiday so I figured it would be Tuesday. On Tuesday September 3 they came late morning and put up 11 posts. He left and said he wasn't feeling well and was going to go get checked out but said they would be back. He texted later saying he had Covid. Sept 4 he indicated his worker *** was sick as well but they were shooting to be back the 5th. Sept 9 he indicated they WILL be there that week. Sept 11 I texted again and he said either the 12 or 13 for sure. Sept 13 I texted and he said he would be back Monday. Sept 16 he responded to my text and said he would be there by the end of the week. Last contact was Sept 18 when he said it would be Fri or Sat. I have called him and left messages and texted him. I am getting no responses from either. I have all texts saved. I now want my full deposit back so I can hire someone else.Customer Answer

I filed a complaint 9/21/24 against Harris Fence Co. We have been in contact with ******* Harris and we have worked out a solution. He has completed part of the project and we have been told he will be back in approximately 3 weeks give or take a few days to complete the remaining part of the fence. Moved into a brand new house and got quotes from several fence companies. ******* Harris came out and gave a quote. He said that they would handle the permit with the city and not to trust anyone who makes you get your own permit he also said the install would be in 2 months. Ended up going with him, thinking we were helping a small business rather than some of the larger companies in town. Paid nearly 80% up front (he said cost of materials). After the check was written for that it turned into over 6 months of us chasing him down for status updates. At one point he said that the city was requiring a survey be done, $700+ later, that was done. I was up front that the builder who we purchased the home from had some pending legal issues with the property from the City and that this needed to be done by the book, and reminded him several times that he needed to get the permit to which he agreed. At one point I asked if the permit had been filed and have it in writing that it had been filed. After much hounding fence was finally installed in July. The city then said it had to be moved due to the legal issue with the builder of the house and the fact that a permit was never filed. The City said if he had filed the permit they would have told him not to put the fence where he did. He said he would move it and never came (even after many follow up texts and calls). Then he said it would be moved by the end of the week (that was two weeks ago and it still remains). All calls and texts have gone unanswered. At this point I will just have another company do it, but I want a partial refund for the cost to move it since this all would have been avoided if the permit was actually filed like I was told.Business Response

Lots of hyperbole here. The fence was put EXACTLY where the customer contracted. The BUILDER didn’t put a ditch between the properties and the city wants the homeowner to move the fence line. In Springfield residential owners are responsible for getting the permit.
When **** asked me to move the fence line it was made abundantly clear that this was between me and the builder. This complaint is not warranted. There’s zero chance we are refunding the entire amount of the job. The issue with moving the fence is between the builder and I, NOT ****.
The ditch was supposed to be put in before the house was built hence the legal problems **** eluded too.
We are willing to move the fence. **** has been contacted. We request this complaint be non founded and deleted.

I am rejecting this response because: there is no hyperbole here. I was told that he would get the permit and not to go with any other company who doesn’t get the permit. As you can see from the attached text I was told the permit was filed…it was never filed. City said they would have told him not to put it there. This was after months and months of chasing him down for status updates and actions that were promised and never done.Business Response

“The city said X”.
When I talked to the city I was told that the ditch was supposed to be in before the house was constructed. I have spoken to a lawyer. He would not respond to my text after this initial complaint. I told him we would come. I even told him that if he didn’t respond that I would just show up. My lawyer advised against that.
He’s not getting back the entire price of his fence because HIS builder didn’t put the ditch in before the house was built or the fence was installed.
If the fence is still on the line I will move it at no charge. If he refuses to let me move the fence we are at a stand still and we will wait for further action on his part.
The hyperbole is what the “city told” him. He did NOT have to chase me down for months. That’s a complete exaggeration.
Either he wants the problem rectified or he is looking to get a free fence. It’s really cut and dry at this point.
Either he allows us to move the fence or he takes further action and we are prepared.
I will NOT refund him.

I am rejecting this response because: I am not asking for a full refund. I am asking for the lies to stop. The builder had not heard from you at all and I was not able to get a response to my questions about why the fence was still up two weeks after I was told it would be down. Not sure why the conversations with the city were “hyperbole” but that is what I was told by both the inspector and the Corporation Counsel. Unfortunately it was clear I could not rely on you to do your part so I had to go with another company as you were holding up the entire process. The ditch could not be dug until the fence was moved. I want to point out that I was 100% up front about this on multiple occasions and asked you to make sure (on multiple occasions) to verify the permit had been filed, given the existing issues with the city. If you “had been in contact with the builder” please provide proof of that and I will be happy to address with him as he said he had not heard from you. The refund I want is the cost to have a reliable contractor move the fence and for the cost of the permit, which you never got, despite the prior provided proof that you said it had been filed.Initial Complaint

Promised fence would go up by 4 to 8 weeks and never was ever put up. Nothing was ever done. I called ***** several times to see if we were on the schedule for them to come out and mark where not to dig. We were not on the schedule. They never ever called to set up a schedule. That wasn’t even our job to call *****. It was the fence companies job. I called them several times my wife called them several times. The only thing they would answer was text messages. I have all the text messages and a copy of the check. Let me know where to send these copies and I can get them to you. I hate to take them to small claims court but I’m afraid that’s what it is coming down to. I now am talking to people where the same thing has happened to them with this company. I would like it to be resolved asap. We are snow birds and came back home to deal with this among other things.Business Response

After talking to Mr ********, he said that he didn’t want a refund and wanted the fence installed. We worked out a timeline and Fence is going in. I contacted Harris Fence in March of 2023 regarding replacement of a privacy fence at my residence. After meeting with them I gave them their requested deposit amount with assurance work would begin on the fence. After months of contacting them asking when work would begin, we had the fence posts set on 8/30/23 with expectations work on the fence would be completed within 2 weeks. No additional work was completed. I have contacted the company asking for an itemized statement to be sent and refund of any remaining deposit. I was told in 10/13/2023 the statement would be sent that day and I still have not received it. We haven’t had a fence for our yard for 9 months, making it less safe for my children and animals. The company will not answer telephone calls from me or my husband.Business Response

We collected a down payment to put Mrs ******* on the Schedule. After an admitted long wait that was out of out control. We set the special order metal posts. She asked for us to be back to mail the job within a time frame that we could not honor. At that point she informed us that she would hire someone else to finish the fence.
As stated there is no refund. She provide 50% of the cost as stated in the contract. More than 50% of the work has been completed and we are stuck with the custom gates that were welded to fit the openings that her fence required.
Note- Mrs ******* also has +50’ more foot of set posts not contracted or paid for as our former Salesman made a mistake in the layout and drawing of her yard.
This was made clear. This complaint is not warranted. The customer got more than she paid for and expects money back.

Sent a down payment of 2,500 in March for poly fence. Have texted both owners multiple times. Fence was to be finished by April. Still no fence. Kept money and won't answer calls.Business Response

I refunded her $3,500.
She wanted a special order item that was 5-6 months out. She kept calling me and I kept telling her I hadn't received the item yet. I did respond to her text messages. She said she wanted her deposit back. I was out eating breakfast and I told her she could meet me and I'd write her a check. She said she wanted cash. I didn't have the paperwork in front of me so I asked how much her deposit was. She said it was $3,500. I went to the bank and got $3,500 in cash and refunded her that day. Her deposit was actually only $2,500 so she got a full refund plus $1,000. I took her word for it.
