    Company is a supplier of aggregate and stone products. The incident in question occurred on 19MAY23, company operator loaded my personally owned trailer with double the requested payload and damaged the front axle. Company is so far refusing to pay for damages, has only offered a discount on material purchased in near future in "good faith", the amount of which is not in line with damages that occurred. Requesting that company pay for parts and labor to return trailer to safe operable condition.

    He actually told the scale clerk that he wanted 7,000 lbs of rock and all the clerk heard was 7,000 so we pulled the rest off to where he wanted it.  When the truck driver got home he called and said that I overloaded his truck and needed to replace his axle.  I told him I would work through this with him and give him a discount to him.  I will try to work with him and discount the material.  I am doing this without any proof of the damage.  For homemade trailers we are very careful with them.  I told him I would give him a discount and get it done by the end of this year and handled by me personally.  He claims an axle was broken, the floor of his trailer was broken.  These are small rocks, twice the size of your thumbnail, and if there was a bent axle he never provided any proof.  He only complained about a bent axle and I am saying that it was a bent axle hi metal floor would have been bent too.  There is no proof of this.  I will try to work with him.

    I am rejecting this response because:

    I provided the business with an email detailing the damages and a quote for repair cost. Business has failed to return calls and emails. The driver asked for 7000lbs and was loaded with 7 tons , which far exceeds the mechanical limits of this trailer, which an operator of such equipment should be familiar with..  A "discount on some product" does not cover the cost of repair.
