      1. ************ is a vendor part of the **** system. I purchased a phone from them on March 17th 2025 for $227.86. 2. I opened a dispute with my credit card company and it has since been closed after they agreed to accept the phone back and send me a refund. 3. I returned the phone and the will not refund my money as we agreed. *********;also played a part by telling the vendor not to refund my money. My next claim will be about ****. 4. A letter was sent to Cellular Stream and eBay stating that the credit card dispute has been closed. 5. Now I would like a full refund and I can buy a new phone. This has gone on for too long.

      Dear BBB,

      The buyer filed a chargeback through their payment institution.  Attached please see the screenshots of the information **** has, we cannot refund the buyer through **** due to an open dispute and **** is the payment processor in this case.  If the chargeback was closed, we would have had the ability to refund the buyer but it seems in this situation **** has taken on the liability to refund the buyer themselves as referenced by one the screenshots but the chargeback is outstanding and until the credit card company reports to **** that it is closed no further action will be taken.  Please note that we as a business no longer have any control after a chargeback is filed and **** takes over, as they are the ones that take the payment and not us.

      I am rejecting this response because: I didnt open the credit card dispute until over a week after the vendor received the returned phone and did not issue the refund. The letter from Capitol One states that the dispute was closed on one of the attached documents. I reattached the document. It appears that everyone realizes that the dispute is closed but ****. The fact remains that CellularStream has my $227.86.

      **** is a marketplace and payment processor for all transactions that occur on ***** we do not have control over that.  The buyer states that they opened a chargeback a week after we received the phone, that is inaccurate.  The buyer returned the first phone that they ordered because they were not happy with the cosmetic condition of the device at which point we provided a return label at our expense and exchanged the phone for the buyer.  In the initial transaction the buyer opened a return request and closed it because it was opened by mistake, but **** would not allow them to reopen it.  We sent the label to the buyer to accommodate them, even though **** policy does not require us to do so after a return is closed.  However we do realize that mistakes happen and out goal is to have happy, satisfied customers.  The buyer received the exchanged phone and then again had a problem, they shipped it back to us and jumped the gun and filed a chargeback before we had the chance to process the return.  We did respond timely to every single email the buyer sent.  After the chargeback was opened, **** blocks all refunds while the chargeback is active.  The buyer, if cancelled the chargeback should communicate with **** in regards to this transaction.  As all refunds for this transaction are blocked by **** to an ongoing dispute.

      I am rejecting this response because: They are incorrect about the exchanges that actually occurred. I told them that I didn't want the phone. I was returned it for a refund. They changed our agreement and sent me back the very same phone a second time. That's when the problem started and they stopped responding to my messages. They decided I was going to keep the phone they sent me, no questions asked, end of discussion. I got so feed up with this situation that I sent one last message stating, just send me a phone or I can pay for an upgrade to a better phone. I believe **** is calling the shots, but ClearStream has been paid. My money didn't evaporate, and **** isn't just holding it in the bank. Thats why I opened up a complaint about **** too. Cellar Stream has received a copy of the letter from *********** stating that the credit card dispute has been closed. If Cellular Stream wants to resolve this issue, they simply need to ship me the ******* S22 that I paid for and that they received the $227.86 for from ****. **** was paid, Cellular Stream got paid and I am the only point in this triangle that had nothing. Cellular Stream can end / resolve this matter by either sending me a phone or persuade **** to send me my money. They are NOT an innocent bystander in the matter.
