Senior exploitation. ** Adjustor scammed seniors (disabled veteran) into signing a contract after storm chasing in the area. Seniors were unaware of contract terms, and insurance money has been sent to the company. Insurance agreed there was damage from storm and now, seniors are forced to pay 1% of amount to ** auditor to release the funds.Business Response

We do not have a client named ******* ****** which is who this complaint is from. However, as explained below, our Public Adjuster contract was signed directly with the owner of the mentioned property, ********* ********.
On 7/6/24 our Public Adjuster Contract was discussed and signed with Mr. ******** after he allowed ** Adjusters to conduct a preinspection to his property to identify if there are any storm damages; storm damage was found and shown to Mr. ******** and he agreed to use our services to get his storm damages covered by his insurance. ** Adjusters had filed Mr. ******** claim on 7/25/24 and Restoration Control (a mitigation company) inspected his property for any interior damages and found damages; this was explained and presented to Mr. ******** as well and he proceeded to allow his property to be mitigated. An inspection with his insurance was scheduled on 8/15/24 but had to be rescheduled due to weather for 8/24/24. On 8/26/24 JC Adjusters received an initial scope of damage from the insurance; they had only accounted for shingle repairs, gutter repairs, interior repairs and the Restoration Control mitigation invoice. We informed Mr. ******** and let him know we would be submitting our estimate and photos to request a reinspection at his property due to his insurance not covering all storm damage; we did so. And on 10/29/24 we received another updated scope of damage from the insurance; they accounted for everything listed from the initial scope but now included the Restoration Control retarp invoice and additional roof material however this still was not a full replacement as we had attempted to get the insurance to cover so we proceeded in our negoitations with the insurance. However on 11/21/24 we received a call from Mr. ******** stating that he no longer wants to continue with our services because he decided to already do the roof repairs himself and would just like us to do the interior work that was approved. **** ****** spoke on the phone with Mr. ******** to explain what the next steps here would be and an appointment was scheduled for the same day at 3pm. **** ****** met with Mr. ******** and discussed that the interior work will be done however since he wishes to no longer use our **************** services, the PA Fee would need to be paid and any remaining funds would be reimbursed to Mr. ******** (as explained in the PA Contract). At this point in time Mr. ******** stated he would like to speak with his son and he would like us to provide copies of all invoices and work done on his claim as proof we earned the **************** fee; **** ****** instructed Mr. ******** he would have this information to him no later than 11/26/24 at 5:30pm at the scheduled meeting.Initial Complaint

Dear ***/*****,I am writing to file a formal complaint against JC Adjusting for their conduct in handling my insurance claim. Below is a brief description of the issues, also I Have attached all relevant information on the situation:JC Adjusting services started on 04/20/2023 with a contract, for hail incurred damages on 04/04/2023 and failed to provide the advertised services leading to the following:Misrepresentation: JC Adjusting misrepresented its services and failed to fulfill its promises regarding the handling of my insurance claim.Failure to Fulfill Obligations: Despite assurances, JC Adjusting did not coordinate with the insurance company and left me to handle the claim settlement process on my own.Billing Disputes: JC Adjusting requested additional funds without providing a proper estimate or justification.Breach of Contract: JC Adjusting breached our contractual agreement by failing to provide the services outlined.Damages Incurred: As a result of JC Adjusting's misconduct, I have suffered financial losses and emotional distress.Abandonment no communication for 120 days and unjustified billing.Business Response

We received your letter in regards to your concerns of JC Adjusters breaches of contract; this letter was in
response to our lawyers letter that was sent to you on 3/4/24 in regards to the Public Adjusters Fee that is owed.
1. Public Adjuster Services:
Your letter states that JC Adjusters breached our contract on acting on your behalf with your insurance company.
The JC Adjusters contract was signed on 4/20/23, our office filed your claim and submitted our paper work on
5/2/23 to American Family. Although our contract states that we will work on your behalf and communications
should go through us directly, insurance companies also have their obligations to contact you directly as well.
Which is why we recommend when the insurance contacts you to remind them you have a Public Adjuster
representing you on your current claim.
2. Misrepresentation of Services:
Your letter states that JC Adjusters breached our contract on 4/20/23 when our Public Adjusters contract was
signed. On this date, 4/20/23, we gave a brief inspection of your property and had found storm damages to your
roofs and soft metals; at that point in time we did not discuss coverage. Our company does not promise coverage
by the insurance, we only discuss and show storm damages that we see on your property from our inspection.
3. Failed Coordination and Inspection:
Your letter states that JC Adjusters breached our contract with lack of communication between your insurance
company and us. ************** filed your claim with your insurance on 5/2/23. ************** had contacted your
insurance adjuster to set up the initial inspection but was not able to reach nor get return calls. On 5/15/23, we
had again contacted your insurance and was told that the inspection already took place. We explained and asked
why we were not informed of this inspection and that was because they claimed to not have our information even
though we had submitted all necessary documents and information on 5/2/23 via phone and email.
4. Communication Breakdown:
Your letter states that JC Adjusters breached our contract with communication with you and requested repairs
estimates. However, till present day and until your letter we received, we had no calls, voicemails, emails, or
requests from you during the entire time. You may have contacted your contractor, Smart Restoration, but JC
Adjusters had not received any communications from you regarding any repair estimates.
5. Abandonment and False Termination:
Your letter states that JC Adjusters breached our contract with no communication until you started receiving our
attempts to collect letters in regards to the Public Adjusters Fee. The reason you started receiving attempt to send
to collection letters from ************** is due to the fact that we had reached out numerous times to see how you
wished to proceed with your claim since your 5/23/23 approval of the roof replacements for your house, garage,
and shed; and we had not been able to reach you even with our attempt to collect letters we had not received any
calls or responses to those letters until you received our lawyers letter had we finally got a response from you.
************** is sympathetic to any causes that happened with you and your family during this time period. **
********* has also been trying to resolve this issue since May of 2023, so it is in our interest to get this resolved as

Dericho came through 8/10/20. After hiring a contractor (up on the rooftop *** or UOTR ***) I was referred to this company. Hired them also. After they came out to my home to take pictures 3 times it is now 8/8/22 and my house is still damaged. Not receiving a call back from anyone at any company. Oh and the person that comes out for jc adjusters is driving an up on the rooftop vehicle. Same with the person the lawyer sent out that was recommended by jc adjusters.Business Response

***************** initially filed a claim and had an initial inspection with Statefarm on 9/13/2020, an initial insurance estimate and payment was sent to her on 9/26/2020 in the amount of $8,604.45. Statefarm had approved a full roof replacement as well as some interior damages.
***************** and ************** signed a Public Adjuster contract on 11/6/2020 after we had inspected her property for storm damages from the storms in the area. ************ informed us that she had a current claim open with Statefarm for the storm on 8/10/2020 and that she already had initial payment as well. ** instructed her that with her signing the Public Adjuster contract we would handle any and all communications with her insurance and ensure that all that is damaged from the storm is restored to preloss condition.
************** filed the necessary paperwork to take over the claim and created an estimate on missing items that were missed to be initially included on the Statefarm estimate and this was submitted on 11/30/2020. Communications were had with the insurance from 12/1/2020 through 12/18/2020 to get a supplemental inspection with Statefarm; this was agreed upon with Statefarm and set up for 1/12/2021. ************ was informed throughout this process as we had constant communication with her daughter ********* via phone and email during this time there was continued information passed about damages. ************** also informed Up on the Roof Top (the contractors hired by ************) many times that work could be started on ************** property as Statefarm had initially already approved a full roof replacement. ************** received a revised insurance estimate on 1/14/2021. Statefarm had approved more items necessary to restore her property to preloss
condition, however there were still few items missing. Therefore ************** had communications with the insurance from 1/13/2021 through 4/7/2021 about the missing items.
Unfortunately on 4/8/2021 we were instructed by Up on the Roof Top that they had involved their lawyer in the claim to take over as Statefarm was not accounting for the necessary items. ************** and ********* received a letter from ********************************* from *************************************** that she was representing ************ on the claim from here on out. On 5/5/2021 ************** lawyer instructed ************** that all documentation from Statefarm is being sent to her office and that she would provide all necessary copies to us. ************** was informed via email from ************ lawyer that two checks were released for $230.14 and $12,104.94, and she provided copies of the checks for our records. On 7/26/2021 and 7/27/2021 ************** received the public adjusters fee where the time worked on the claim before ************ 'lawyer was involved.

JC Adjusters protects ourselves and our consumers by making sure the contractor of choice (chosen by the insured) does the job accordingly, for that reason a signed agreement is made. The agreement between Up on the Roof Top and JC Adjusters is not a contract with ************. The contract that is signed by ************ is the Public Adjuster contract that allows us to work on her claim on her behalf, not to do the construction. We would like to remind you that ************** were your Public Adjuster on the claim, not the contractor of choice. The Public Adjuster contract signed by ***************** can be provided at any given time necessary. ************** have photographic evidence that the work on the roofs have been completed.

On 8/19/2022 the Public Adjuster went out to your property and confirmed on site that the roof was completed, the Public Adjuster also had spoken with you in regards to the roof as well.
We understand you are rejecting our responses and we apologize for any inconveniences you are going through but as you can see in the photos attached your roof was completed. As your Public Adjuster it is our job to ensure the roof was completed accordingly and from our review of photos and property visits, the roof job was done. As mentioned before we released ourselves back on 2/28/2022 as your attorney took over and we were no long able to work on your claim as it was being handled through lawyers.
We apologize but there is nothing further we can do.
