      On 4/8/25, my car was involved in an accident. A tow truck driver named ***** *************), from **** Towing and Recovery offered to tow me assuring me repeatedly that my INSURANCE would pay for it. When he towed it to the repair shop, he demanded that the REPAIR shop pay him for the tow and when they explained that it was the INSURANCE that pays that, he towed it away to the **** lot. He told me to have the insurance tow call before they come *** ************) and then **** didnt answer the phone calls and the insurance tow company had to call me to get the Drivers phone number. This went on for several days until the insurance tow company was able to reach anyone to arrange the tow. My vehicle was finally towed on 4/14/25. This caused a lengthy and unnecessary delay in my car being repaired (and Im sure it cost my insurance extra days of storage payments). In addition, **** locked the keys inside the car, so I had to take off of work to run a key over, only to find that **** had left the key in the ignition with it turned to *** (the repair shop employee can verify this finding). This caused my battery to be drained for several days and now I have to get a new battery for my car. I am very unhappy that the company assured me that my insurance would pay and then expected the car repair company to pay them and that they were negligent in leaving the ignition in ACC and locked the keys in my car, further delaying the repair of my vehicle. Note: While the receipt they provided me lists the Westchester address, the address provided to me by the driver (and where the car was eventually retrieved from) is: *******************************. I would like my car battery to be reimbursed as well as any storage fees, Dont forget that I had to take time off of work due to their negligence as well. As an act of goodwill, I am not seeking compensation for that time.

      First and foremost, we would like to apologize for any inconvenience. This matter may have caused, but the truth is the Tow Driver named ***** told the vehicle to the repair shop crash Champions located at ***************************************************** upon arriving usually the repair shop cuts a check to the Tow Driver to pay the fee. The repair shop then keeps the car and gets reimbursed from the insurance company. The shop did not issue a check, therefore the Tow Driver did not get paid following protocol. The *** driver relocated the vehicle to our facility our secondary lot in ******* on Cicero the insurance company was made aware of the situation. The insurance company to vendor call me on April 10, 2025 on a Thursday to schedule a pick up for the car from that point on there must have been some miscommunication between two insurance companies, one being ****** and the other one ************** and the Tow vendor that was supposed to pick up the car cause the delay. We do not have any control of that so finally on April 14, 2025. The tow truck shows up to pick up the car with payment. We then release the vehicle with keys inside the vehicle with the doors open the tow truck driver proceeded to load the car and took off as far as the battery being drained due to our fault cant be true. Keep in mind. This vehicle was involved in an accident again we apologize for the inconvenience, but she could have called ASAP Towing management directly to address her concerns. We at asap ********************************************* are a family owned business that have been around for years without any complaints due to the respect and helpfulness we provide our customers.       I am rejecting this response because:

       

      I do not appreciate the implication that I was untruthful which invalidates the apology.
      The response from the business is from ** ****** who was not at the towing incident where the tow truck person, ***** told me that he would tow it to the REPAIR shop and my INSURANCE would cover it. Mr. ****** was no witness to this as he was not present. The other driver that was involved in the accident, ******* A,  WAS a witness to this. I will provide her last name &  number to the BBB, but I will not release her personal information here to protect her privacy.  I also have a copy of the police report which has her indicated as being present. The driver never said that the REPAIR shop would be expected to pay the tow or it would be towed away. He also did not attempt to call me to tell me there was a problem so I could try to rectify it. Instead, he moved my car to an unauthorized location.
      Regarding Mr. ******* claim that the keys being locked in the vehicle and set to ACC and the battery drained under their watch was incorrect, I have attached screen shots of my ************ that show that the cars battery was drained and the the car was armed and locked on 4/9/25, long before the car was towed by my insurance company on 4/14. For **** to blame my insurance companys tow is ludicrous as it was not in their possession until 4/14.I was careful in taking the screen shots so that they overlap so that you can see that it is all one report and that it is for the vehicle in question. You will see that there is no future action on the vehicle after 4/9, as the program will not operate once the battery is dead. If the battery had been drained after the tow on 4/14, there would be reports showing that the vehicle was opened and that it was moved. You will see in the shots that the vehicle still says it is in ASAP tow lot because the battery has yet to be replaced. It is not possible that it happened the way Mr. ****** reports.

      Again, we are sorry for this inconvenience, but we are not responsible for the delay caused by your insurance company and their toll vendor and we are also not responsible for your battery being drain and if it did good drain good batteries can always be charged. Doesnt need to get replaced thank you.

      Even a good battery, when drained for that long, will go bad. This was confirmed by the repair shop. And your personnel is STILL responsible for what he told me.
