    This company represented the seller in a real estate transaction, in which I was the buyer. I put down $9,500 in ******* Money. Sellers damaged numerous walls on move out, and neither the seller nor their realtor notified us or requested to change the date of closing which they chose. Instead, they tried to change the terms of possession less than 24 hours before closing, after we drove 3 days from our home in **, and were in ***********, IN, which was not acceptable to us.Although we signed a Release of Listing requesting our ******* Money be returned, the listing agent gave the money to her client, alleging sending a letter saying the money was going to her client. Our request for Proof of Delivery of such a letter signed for has been ignored.

    Mr. **************** few clarifications on your accusations. 
    - Sellers took full responsibility for the minor damage to the walls in the garage and some additional nail holes/blemishes on the interior of the home. They hired a professional painter to make repairs and repaint those areas. When we were notified it was not acceptable to you for the painter to come back for a final coat the day after closing, we reached out to the painter and he came back after hours to do another coat so all work would be finished for the final walkthrough at 9:30am the day of closing. 
    - The home was ready for possession before the scheduled 11am closing but you failed to attend the closing which was a breach of our contract. We followed the procedure for the ******* funds outlined on page 1 of the offer to purchase you signed and presented. You had 60 days to file litigation which you did not do so we released the funds as outlined.

    Please ask Sterling Real Estate to provide proof of delivery signed for by myself or my wife (the only two people in our household) notifying us we had 60 days to file litigation. Notice was not given to us until after they gave our money to their client, and that was by email/text message.
