    Callow Concrete signed a contract on September 24, 2021, to install concrete replacing the gravel driveways to the house and pole barn, and the last line was, "Callow Concrete to provide ****************** along perimeter of new drive." Our verbal agreement was from the top of the of the driveway smoothing into yard four feet. After the last concrete pour, it became so rainy that our yard, containing ***** became impossible to finish the above since his bobcat created more damage to our yard than was being fixed. I created an addendum to the contract that we both signed on October 28, 2021, which stated, "the new drive located at ******************************************************************, cannot be properly backfilled due to the lack of quality topsoil available and the wet condition of the yard at the aforementioned property." It stated the work "will be completed no later than July 31, 2022, unless weather conditions do not permit and both parties agree."We have been in contact several times since the middle of June 2022 and only one additional load of dirt, containing large pieces of broken brick, has been added and gravel removed before pouring the concrete as simply been smoothed in other areas without topsoil. There are also areas with clumps of concrete along the driveway with no topsoil. The driveway to the house alone is 175 feet long and then to the pole barn, so it is a substantial amount of work left to be done. ******************************* sent me a text on September 11, 2022, and I sent one back the following day asking him to call me on Sept.13, 2022, which he did not. I sent him a text on Sept. 13, 2022, no response, another text on Sept. 29, 2022, to which he replied he would contact me that evening, but today is October 3, 2022, and he has not.I understand Callow Concrete's business is during the warmer months, but this delay is unacceptable. I paid the entire amount of $35,000 and offered to allow him to refund $3,000 but would prefer he finish the job as signed to twice.
