    I paid g diamond transport services ********* plus 15% interest for a 2016 international prostar, final payment of ******* was recieved June 3, 2024.Now the vice **************************************** of g diamond transport is holding title to truck after it was paid for, demanding another ********? , to be paid before she releases title, the ******* has no part in contract for purchase of truck.

    This person is not a customer but is a disgruntled vendor.  He was an owner operator who purchased a truck from G-******* Services, LLC and leased it to G-******* Transport.  He signed an agreement with G-******* Services to purchase a truck.  He signed a lease agreement with G-******* Transport to run the truck.  He signed a contracts stating that any money due to either company could be paid from monies due to him from the other company.  In this case, he refused to return company property namely the electronic logging device, toll transponder, dash camera, and the truck plate, etc.  He did not insure the vehicle against liability and physical damages causing us to have to insure it for 11 months. He failed to respond to emails asking  him to return the property that was costing G-******* Transport money monthly.  ************ refused to return the items until it suited him to get the truck sold.  When he requested a pay off on the truck, he was advised that it was $8,583.68 which included all the costs the truck incurred being part of the fleet with us. I had made a mistake and not charged him the 11 months of insurance that we had to cover for him but since it was my error, the company was willing to write off that balance which amounted to approximately $3025.00 additional.  ************ remitted $7,402.03 and thinks we should just let the title to the truck go since he sent partial payment.  He continues to send threatening emails and he told me that he was going to complain so this is not a shock at all.  He is misrepresenting the facts and chooses to ignore that he signed contracts for all the amounts we are claiming due.  He misrepresented himself to the BBB as a customer when he in fact is a vendor to us and not a customer.   ************ is trying to use any means he can to get out of his legal obligation including dragging our companies through the mud.

    Per all contracts that were signed, one states specifically it supercedes all other written or verbal agreements. As per the contract it does not state anything about monies from truck loan being used for anything. All monies due come directly from wages for deliveries and from bond payment. Contract for truck loan does not state that title will be held. Title will be released once the loan of ****** plus interest is paid. That has been done. 

    All truck loan statements I have received from g diamond states nothing but truck payments, nothing else.

    Statement added clearly shows from time I got truck on loan from company that there is no fuel tax, or anything added or deducted from loan, other than truck payment and interest.

    ************ continues to ignore his obligation to satisfy all the accounts he had open with us.  He is not a customer but a disgruntled driver who tried to scam his way out of paying what he owes and now that it is not working for him, he is complaining publicly.   We will not continue to go back and forth on this issue.  ************ owed money that was not just on this particular account but other debts this truck incurred in the course of business with our company.  These are things we had to pay on behalf of his truck for his benefit which he was to reimburse us for per our contract which was previously provided.  

    We will not be bullied into giving up the title to the truck until all the debts the truck incurred and is responsible for are paid. ************ is welcome to settle this in court in ******* as the contract calls for if he is unsatisfied.
