    I am the executor of my husband's estate (***** ******). He owned land 50/50 with his brother ******* ****** which has always been leased out for farming. ******* decided to lease the properties out for hunting without my knowledge. The leasing company is Base Camp Leasing and the properties are located in ******. I have been asking for copies of the leases due to them being part of probate and other court proceedings. I have sent them court documents signed by a judge as the executor and they are not cooperating. ******* is not willing to give me access to the leases either. As executor of my husbands will I have the authority to manage the estate's affairs, including maintaining property. I am responsible for carrying out the wishes of the deceased as stated in the ******* husband worked hard to obtain this property and to have it leased out to hunters that have spray painted his hut and tearing up the ground is disgusting.

    ******, Base Camp Leasing is more than happy to comply with any and all requests from an attorney.  The documents you sent us simply state that you are indeed the executor of his estate.  What we do not know is what the estate includes.  We would need documentation that the parcels in question are indeed part the estate and that you are part owner.  Please note, Base Camp Leasing was contracted through the other party you mention in your complaint to advertise the hunting rights for these parcels and that he executed the licensing agreements with the hunters.  He as stated that he was sharing those licensing agreements with you.  If you still need the licensing agreements from ***, please provide us specific information on those parcels that list your interests as an additional owner and we would be happy to assist.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 

    Base Camp Leasing does not need to hear from my attorney. I gave them a court document signed by a judge stating I was the executor of my husband's estate.  Anything that shows in his name is part of the estate.  ******* ****** has no power over what happens with my husbands estate and is not in charge. I should not have had to go through this process but I will not be taken advantage of.  I received the lease agreements and will not need anything else from Base Camp Leasing.

    On June 28th I placed a deposit on a property. The listing showed aerial photos of the property. There were two tree lines in a field highlighted in green. Upon inspection I learned that the tree lines had been removed from the property. I immediately contacted Base Camp Leasing to let them know of their error to receive a refund of my deposit. I was told this would need to be discussed with a supervisor. I have emailed **** and requested this conversation. I have received no response. Recently a new property has come up for lease and it clearly states the areas in green have been removed. They clearly incorrectly listed the property and did not include all pertinent information. They falsely advertised the property knowingly or by accident.

    Base Camp Leasing makes it clear that the deposit is non-refundable.  This is why Base Camp Leasing allows hunters access to the directions to the property so they *** properly inspect it before making a deposit.  Landowners are required to notify Base Camp Leasing if there are any changes on the property that *** affect the description or marketing assets such as photographs taken on the day the agent inspected the property.  We understand there is a high demand for hunting property and that quality leases don't last long when they are advertised.  This does not however negate our policy of a non-refundable deposit to hold a property for inspection.  Please see the attachment that shows screen shots of how hunters can get driving directions to inspect the property.  In addition, once a hunter clicks on "make a deposit" to hold the property, please see the agreement that a hunter must check to acknowledge it is a non-refundable deposit.  At this time there will be no refund.
