      We accepted a bid from Thieneman Concrete for concrete work to be done. The scope of work would include footers, footer walls, 4' to 5' tall retainer wall, two walls for safe room and slab for a 45'x60' garage. At the end of the job, BUT before all the work was done, he gave me an amended bill which I had never seen or agreed to. We paid the original agreed to amount of $35,078.50. This disagreement may be the reason he is not returning my calls or text messages.
      The reason I am filing a complaint is because my retainer walls have long and widening cracks vertically AND horizontally and water is coming through. We are just asking for the footers and footer walls to be repaired.
      I contacted ***** several times about the problems starting on July 9th, 2021, the 10th, 14th and 20th to this day by text messaging and several voice calls have never been returned. The latest call was October 31st, 2022 and still have not received a reply.
      Paid by check #'s *** *** *** for a total of $35,078.50 dated July 9, 2021 to Thieneman Concrete.

      We, at Thieneman Concrete Walls, did do a concrete job for ****** ****** at her son’s property at **** ** ****** **** ****** ****** **  *****.   We did submit a quote to Mrs. ****** with the estimated cost of the job that was bid according to the plan that was submitted.  Once the job commenced, there were changes on site that were different from what was bid.  The side walls to the garage were bid at 5 to 6 feet, but when the footers were dug down to solid ground, as is required, they were 8 foot walls.  The bid amount on the retaining wall according to the plans that were submitted to bid was 12 feet, but the slope on the job site required 20 feet of retaining wall, which was an additional 8 feet.  We also had to hire concrete pumps for the job because the lot would not allow the concrete trucks to enter the job site without creating a safety issue. All three issues were discussed with Mrs. ****** at the time and she did not indicate that there would be a problem with the additional charges being paid.

       

      After the walls were completed, Mrs. ****** requested a bid to add a storm shelter inside of the garage.  The price quoted to her was $5,000 plus materials (i.e. concrete, rebar, etc).  Again, there was no issue with the increase.  She also requested that we seal the floor, which we did, with the understanding that it would be an additional charge.  The total overage for this job was $12,469.35.  Mrs. ****** did pay the $30,278.50, which was the original quote.  She also paid and additional $4,800.00 toward the cost of the storm shelter.  Although we have explained the increases to Mrs. ****** several times, as of this correspondence, we have not received any additional payment.

       

      As far as the cracks and leaking that Mrs. ****** has claimed, we have not addressed these issues because excavation and drainage were not part of the scope of our work.  Walls crack and leak because there is water pressure against the walls.  We observed from the road that another company had backfilled the walls.  We have no way of knowing if the leachtile was extended to drain properly prior to it being backfilled, or if the dirt around the retaining walls were graded to allow the water to drain properly. It appears that instead of there being a concrete issue, it could be a drainage issue that is causing the problem.

       

      If Mrs. ****** will pay the remaining balance due for this project, we would be willing to go to the job site and access the situation.  At that point we could determine what, if anything can be done to rectify the issue.
