On June 30, 2023, I was quoted a price to rebuild a privacy fence at my residence. The cost was $140, not including material. I paid the $140, with the agreement that on July 5, 2023, the job would be completed. After numerous cancellations and excuses, I requested a cancellation of the job and a refund of my money. That was on July 16, 2023. At that point, I was told that I would be given my refund on Friday, July 21, 2023. On Friday, they had an excuse where they could not meet to give me a refund. I was then blocked on ******** and ********* where we were communicating. I then texted them via the phone number on their business page on ********. I was told that I couldn't couldn't get cash back. The refund had to be sent through my debit card that I used to pay. Needless to say, I didn't receive any refund and I am not blocked and cannot text them. I have my payment receipt and all the correspondences to validate my claim.

    Business Response

Some of the information the customer has provided is false we do not have a ********* page. I only blocked her because she is harassing me and threatening me. She's threatened to send someone to my house and break my things. She only gave me $132 because with a card we charge a $5 fee the total amount of the project was $140 that was if she picked the materials. I have a square account which takes the percentage off of that and therefore I only got 132 of that pay. The project was never started because she said she had stuff to do and she cannot make it to ******* that day so let's plan for a different day. She did not have a way to pick up said materials therefore I would have been picking up materials on top of that and not being paid for it. And it was not rebuilding a privacy fence it was repairing a privacy fence gate entryway. Then as she was paying for the repair she told me that I was going to replace pickets on her fence as well and told me that I was responsible to get 30 extra pickets for her fence I did not bid her to repair her whole entire fence just the entryway. By changing the agreement by trying to add to the stuff that was never bidded therefore when she violated the contract by canceling services and she went back on her agreement that there's nothing that can be done.

    Customer Answer

I am rejecting this response because: The owner is not being truthful with the assessment of the situation. One, it is true I wanted a gate built for my fence. That is the only part correct. I am attaching the payment I made and all the communications I had with the owner and his girlfriend. My daughter gave me his name to see if I could help out his family because he was just released from prison or house arrest or work release. Not certain which one. So, on June 29, I started communicating with his girlfriend, *******, via ********* Messenger. My daughter was included in the conversation. They came out on June 30 and quoted me a price of $140 to rebuild the gate and replace old slats in my fence. This amount was only for labor. I was to pay for the material. I paid him $140 on June 30 (it posted to my bank on July 3 and I have attached the receipt). The agreement was ***** was going to go to ******* and "build a project" to repair the slats and build the gate and he was to give me a job number. At that time, I was to go to ******* and pay for the job, using the job number he gave me, and I was to get the materials. On July 4, I reached out via ********* Messenger, to verify that he was going to do the job he was paid for at the time he said he would. ******* responded back (indicated on page 3 of the conversation) that they had a family emergency and was out of town. I page 4, since it was for a "family emergency" I indicated I was fine to postpone but I also stated I wanted the job organized at ******* like I was originally told would happen. Then, on July 6 at 10:43 I received a message, via ********* Messenger, stating that he needed cash to get the supplies and if I could ******** Pay him. He was to give me the total and I was going to add 7% to the total for the sales tax and I would ******** pay him and he would get the materials and complete the project. At 3:12 the same day, 4.5 hours later, I told him I had an appointment and could not make a payment. He gave another excuse as to why he couldn't complete the project. Then, on July 12, ******* reached out, via ********* Messenger, and asked if the weekend would work to do the job. I stated that either day would work. She then stated she would let me know Friday when they were available and I would go to ******* and get the material needed. She indicated, on page 9, that she would let me know when they were available to go and get the material so I could pay for it. On July 16, after not hearing anything else from the owner, I sent a message via ******** Messenger to the company page. I switched platforms because my daughter was included on the prior conversation and felt she didn't deserve to deal with it any longer. I asked for my money back because there were too many excuses and no effort to do the project he was paid to do. After a bit of back and forth, it was agreed he would give me my money back on Friday, July 21. On July 21, I reached out when to meet for refund of my money. After another excuse, I did not get my money. I reached out again on July 24 to get my money back and was, yet again, given another excuse. I sent a few more messages via ******** messenger that were not responded to and then I was blocked. I then sent texts saying I planned on pressing charges and that I wanted to verify his address. I NEVER ONCE THREATENED VIOLENCE OR TO "BREAK HIS THINGS." I was then told it had to go back on my card and it takes 7 - 14 days to process. That was on July 27. On July 31, I sent another message asking for a confirmation code regarding the refund. That is when I realized I was blocked. I then went back to the ********* messenger and I was blocked from that too. I have proof, IN WRITING, that he was paid for a job that he did not complete and was lied to repeatedly. I WANT MY MONEY BACK! If I get my money back, he will never hear from me again!
