      We closed on a new house construction giving hallmark close to $90,000. ******************* ************* disappeared, no one can contact them. Hallmark now want to keep our down payment, they have to the construction ** 10% of our money and they refused to give us that money back. This is the letter I sent to Hallmark: We know that it may not be the right time for one reason or another hardly describes the nightmare we have been through. Your clients employee, Loan Officer knew exactly what she was doing. Her boss *************************** chose to look the other way because she was bringing him so many clients. Your client is required by law to return the unused portion of our downpayment proceeds. Hallmark Home Mortgage was supposed to be looking out for our best interest. We have been advised that every closing department reviews the contract, seller contribution and commissions. **mmissions are always paid by the builder/seller-It was right there in our contract- yet Hallmark went with the request from *********************************** to take it from my downpayment. Your client knows they have made a serious error in judgement. They looked the other way and enabled these awful people to steel our hard-earned money with no intention of building our home. Lenders are supposed to verify a builders financials and history before allowing them to engage in one of the most important financial transactions you can make. The following is not negociable Return of the following:$43,892.39 of our $90,000. We had lost. The return of the relators commission $19,697.94 as Hallmark was negligent in allowing them to take that from our downpayment at closing.We are willing to sign a document releasing Hallmark Home Mortgage as a company, however-not ***********************************, Lawyers Title, ***********************************, SteelX and any of its employees. Please let us know your decision as soon as you are able as we have decisions to make. Now they totally refuse to give us our money.
