    My wife and I moved to ********** from ******* this fall. We bought a house . Met with ******** **** from JDB Floors and More and decided on some of the designs of the bathrooms and we agreed to pay them a deposit of $7300 to begin work in our master bathroom. ****** from JDB Floors and More began working quickly and within the first week, our master bathroom was demoed. After our bathroom was demoed there was a week where no work was completed in our bathroom. The third week rolled around and ****** work became sporadic and unorganized. He worked on plumbing, electrical, the showered base, tiling, dry wall and building a dividing wall between the shower and the vanity area. After part of the shower tile was completed my wife and I were both unhappy with the way it looked and it was clear that there were major issues with ****** work throughout the whole bathroom. We asked ******** **** to come and look at it but we were reassured everything looked great. It was later found that the dividing was was not even secured to the bathroom ceiling. Our water heater needed serviced, so we had a plumber come out. The plumber couldnt shut off the water to our home. It was eventually determined that a valve replaced by ****** in our master bathroom was faulty and would not shut the water off completely. The plumber told ****** about the issue so ****** ran to the store to get a replacement valve. While ****** was gone my wife had the plumber take a look at the progress being made in our master bathroom. The plumber even commented that the tile work looked terrible. ****** replaced the valve and the water heater was able to be worked on. Then my wife noticed that while ****** was working on the electrical fan/vent, he was struggling and it did not look like he knew what he was doing. My wife asked ****** to stop for the day so he did. I have attempted to work with ******** about getting our deposit back but she has stopped answering our texts or calls.

    Attached is the explanation of the Eckmeyer project from start to finish.  ** are professionals and were not finished when *** ******** decided to ask our installer to leave and she and her husband hired JDB Floors to remodel two bathrooms.  All materials were approved by *** ******** and were ordered with their deposit money of $7300.00 and that also paid for the demo of the existing wall and bathroom fixtures, vanity and flooring.  the materials to build the shower were also paid for with that deposit.  ** had every intention of returning and making any modifications to satisfy them.  The problems found later with the foundation under the shower we almost completed were not discovered until later by another contractor and the entire shower needed to be removed and the *******'s hired a different contractor that told them that we used inferior products and that the entire shower needed to be redone.  ** follow the Ceramic Tile Counsel recommendations and have over 25 years of experience in the is industry and were using the correct materials.  Please see attached the final invoices showing paid and itemized list of materials and labor.  If the Eckmeyers would allow us to return some of the items still in their possession we would refund them for those items on those invoices.  However, they had work completed and we have been paid for the demo and the partial construction and that is reflected on the invoices attached.  The remaining refund amont is still pending due to materials needing returned.  I hope this helps explain the situation.  ** take pride in our work and were not allowed to finish this project.  ** care about our customers.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 
     As customers, the ones who have to live with the finished product, we chose to have work stopped before it got out of hand .The work completed was not acceptable. We are looking to resolve this in a professional manner. Work was performed and materials used, we are willing to pay a fair amount, but that amount does not come close to the amount we gave to begin the work. I feel a refund of $5500 is fair,  and the materials that are still in our garage will be returned to jdb.

    We are sorry that this customer chose not to allow us to finish the bathroom and are confident they would have been happy if they would have allowed us to finish.  We have many happy customers that have had us remodel their bathrooms and this has never happened before.  We are a small company and do not have unlimited funds to pay back once the customer pays the deposit which allows us to buy materials they have approved.  Our installer worked for a week and was paid for his labor for that time with part of their deposit and materials used for the shower were paid for with their deposit money which were installed and therefore cannot be returned.  We have receipts for the tile, mortar, grout and shower pan as well as the lumber and will gladly supply them if necessary.  The soaker tub, heated ceiling exhaust fan and a faucet is still needing returned by the customer to be able to issue a refund for those items to the customer.  The demo was paid also with that deposit.  The cost of the labor, materials and demo for what was completed is all that we are unwilling to refund to them.  Please see the revised invoices previously sent.  Thank you.

    Again the response does not try to rectify the issue. Yes you had demo, a week of labor and some materials, that is much less than the deposit we gave.

    No offer or contact has been made, that is bad business. As a business or personal you have no right to keep our funds owed. 

    Unfortunately our next step is small claims court, we have an attorney, who you have not responded to, scheduling a court date.
