    On 4/4/23 and 6/3, I sent emails to my HOA/HOA Management company outlining multiple safety concerns to contact me, so I could further explain the serious safety hazards occuring in my area regarding other neighbors. I've talked over the ***** with my HOA management company one time and they refused to give me my HOA President's ***** number. Our HOA is nonexistent and let these issues happen daily. I want the President of my HOA to call me regarding my documented safety issues which includes police reports. *** is ********** and the President's name is *******************************. I am refusing to pay my annual HOA fees until I am contacted. The way our HOA/HOA Management company is operaing is unethical.

    Please let me start out by letting you know that we are only contracted to handle the "financial" aspects of your community, every other matter, including the ones you mentioned, are handled by the *** board directly. It is not in our ability to provide a volunteer board members personal phone number. We have posted the board's email address publicly for homeowners to use to contact them and we have no control over their responses. 

    We recommend that you refile this complaint on the *** directly. Thank you.

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this response/resolution is satisfactory to me. My HOA Secretary contacted me a few days after the complaint, so word go around to them and they reached out about the safety concerns we are having. Complaint can be closed now.

    I have been paying into this HOA for 3 years now. They have yet to respond to any covenant violations. They simply respond that someone came out. Recently, they did not pay the ***************** for our community street lights and they were turned off for over a month! In the Winter, one of our community members had to pay for snow removal because YourHoa would not. There are clear violations, and I have submitted them as instructed. This company simply is aweful. Please call me for more examples because i have approx 20.

    When you live in an association that is still in developer control, things can seem like they are taking forever. We understand. 

    Let me explain the relationship between the developer, the homeowners and the management company.

    As long as construction is still occurring and a large part of the community is unsold, the *** and community itself are still under developer-control. The developer first establishes the Community Association, creating the first governing documents, CC&R's and other establishing documents. They will also create an operating budget with reserve funds, tax filings and may appoint a third-party Management Company to assist in the community's day-to-day management. A developer's powers determine by weighted votes, which determines by lots. In the beginning, homeowners aren't as involved in budgets when the *** is developer-controlled. Different states have different laws regarding community associations controlled by developers and how much they must involve homeowners.

    In this case, the association management company is merely the liaison between the developer and the homeowners until the turnover of the community to board control. At that point, the homeowners will appoint a board of directors, and the board of directors will carry out the homeowners wishes within the guidelines of the community documents. 

    Until the turnover, the power of the homeowners is limited to the developer. The management company and its representatives do not make decisions for the community. These decisions come directly from the developer. 

    The Indiana Laws for ***s are very strict on how violations are handled and a lot of times the process can take a while. We understand the frustration. Just know that as the liaison, we are doing everything we can with the current governing documents and the developers plans.

    9/30/22 - ********************* in response to the businesses response...

    I have multiple examples of the developer clearly stating that he does not have anything to do with the **** I also, as seen in the response, have many examples of the *** stating that it is the developers problem to fix.  It has seemed like it has taken forever, because there are still issues from over 2.5 years ago that are still ongoing. The community is 100% sold!  I have copies of the covenants and have spelled out each violation in communication with both the Developer, and YourHoa many times via, email, phone calls, entries on YourHoa's website etc. Not to mention the verbal attacks that I have received via the community members, after my name being slandered by both parties mentioned. All the while, each and every homeowner is paying for services that are not being rendered.  There has been one small meeting that only a few people attended, and that is all. Communication is awful, follow through is awful, The lies and deceit have to stop. The whole community is fed up and needs results or refunds.

    All of the above issues still exist. I have many documented conversations that provide many violations, theft and outright neglect. Money is still  being collected and not used on the community.
