I had my ***** suburban towed to his location November 15th, 2024. He told me that he would fix my car which he said he would do because he did not fix it the first time. There has been a piston issue and spark plug issues. On november 21st he said in a text message that he stripped a head bolt on the cylinder head and he had to order a special kits to rethread and repair the cylinder. He said sends voice text on his response telling me that he is working on still and he has other customers to helps. So I had to pay for additional spark plugs kits that cost $196.59. which i paid via cash app. He told me that it would be done the first week of December and I asked him like the 6th. He responded and said yes. On december 5th he tells me that he is weighing his options to swap the engine. I asked if I will be charged and he said that he was not charging me. time went by and I kept texting him with no response and I went by several time. he called me that he was getting the engine from ******** and was waiting for it and it cost him $1200 and it was paid for already. I waited and waited and he sends me a video message that said that he had an electrical fire at his shop on december 31st. On Jan 7th in a text he is stating that he was in a bad accident and he split his forehead open. he as not responded to me at all. I went to his shop and I have a video showing that he has not worked on my car and it has been sitting in the same spot since it was dropped off. I have all the text messages showing this. I would like my car fixed and repaired and he has also stated that he is working from another shop temporarily until he gets his shop fixed. he does not answer his phone or responds to text messages at all. I call and text every day with no response. I can not get my car fixed or out of his shop because it is sitting so far back that it is backed in by other vehicles. I would like my car fixed asap. I think it is disrespectful and he is holding my car. is this criminal?

    Business Response

    Date: 02/20/2024

Vehicle was diagnosed in December , customer requested quote for an engine job & timing chain job to compare and see what was most cost effective.

after being given quote for both customer requested to do engine for longevity purposes.

customer agreed to pay parts portions of invoice as is customary with all repairs at the shop .

after agreement was made two weeks later custoler faltered on agreement stating he lost his job and that he would take the truck home . No push back fro the shop and no storage fees due .

customer then stated he wanted to sell the vehicle because shop had an interested buyer , customer agreed to one price then came back and claimed he had a buyer for higher . Shops buyer declined offer to buy .

then customer came buy a week later and said he would like to do the timing instead and inquired about price again . Customer said pricing was fine but requested if we could get it a tad bit lower .

being that it was the holiday season and customer was from out of town shop lowered pricing in order to help customer get back on the road .

customer and shop made a verbal agreement that vehicle repairs would be paid on while vehicle was being worked on since price was being lowered to benefit & assist customer customer agreed .

customer called shop a few weeks later and said hed pay for the full job up front. Customer sent the shop $400 two weeks later .

once payment was received repairs did begin . Upon testing vehicle down again noticed that during initial inspection technician missed the fact that 4 bearing caps ok passenger side of the cylinder head were broken off due to continued operation while failure was occurring, bearing cap retaining bolts were also broke off in the cylinder head updated customer of new found issues & informed that there will be additional cost and labor added to the repairs . Updated customers invoice and sent it over and customer agreed to new pricing and sent payment towards it

customer then stopped paying & *********************** dropped as well per agreement  . Customer popped up a few weeks later and said he wanted to pay his full balance and pick his truck up . Alerted customer that that was not the agreement made and due to stopped payment shop had to take other jobs to supplement income and operating costs .

customer got upset cause we could notmeet his self imposed date .

customer still owes $1300 but requested that the shop allow him to pay $400 and take his vehicle home and hed pay the rest when he got his taxes . When shop declined the offer the customer began to slander the business, threaten the owner & the owners family, and the owners children . Stating it was not personal but all business. However the customer states he will PERSONALLY make it his business to put the shop out of business.

I had my car towed there for repair he was paid by the warranty company & then got rid of my vehicle

    Business Response

Customer had a no start no crank issue ,  brought her vehicle to the shop for repairs under warranty.after diagnosis came to the conclusion the customers vehicle needed an engine .

warranty company asked for tear down to the point of failure to prove engine issues . **************** stated they would cover tear down cost if the engine failure was covered .

after tear down warranty company gave approval for engine replacement upon the contingency that I pay for the replacement engine and provide invoice .

upon informing customer that that was what was requested of the warranty company and that is not how I operate gave the customer two options either pay toward the balance of the engine so it could be purchased . Or I would purchase it when I had the available funds to do so .

neither situation was feasible to the customer because of cost / time .

customer said they were going to buy a new vehicle instead . Customer stated shop could have the vehicle . Notified customer that when I bought the engine I would still submit invoice to warranty company to recover money from work done because no payment from warranty company could be released . Purchased new engine sat it inside the housing of vehicle and began reinstalling the engine . A few days after purchasing engine I came to the shop and the vehicle was gone . ************** notified me that the vehicle was up for repossession suspect that the bank took the vehicle off my lot while my lot was unattended, leaving the shop out of money from purchasing an engine for a vehicle that owner ship was relinquished of by the customer.
