    I have a signed contract with A New Way HVAC/****** **** to replace my AC and furnace for $5000 dated August 19, 2024 (attached). I paid ****** three payments for a total of $4850 as requested to do the work, communications are attached. ****** sent a colleague, *****, on August 27, 2024 to disconnect my AC unit but did no other work. ****** has never been on my property and has told me on many occasions he was on his way to do the work and 'see you soon', yet he has never shown. He now refuses to answer his phone or return my money. I am requesting a full refund of $4850. We had no AC all summer and currently have no heat going into winter. This man has lied numerous times and was recently arrested for theft and fraud (attached).

    Our air conditioner compressor was having issues on August 19th 2024, and ****** **** from A new way HVAC (previously known as A new phase heating and cooling) came out to our home and told us that we needed a new compressor and wiring. We were out of state at the time but he assured us the work would be completed and to pay his mother ***** ****** via ***** and he would order the parts and complete the work. We signed a contract stating he would install the new compressor and parts. When we arrived home September 11th 2024 we noticed that the home smelled musty and was extremely hot. The Air conditioner had not been fixed or the new compressor installed. We contacted ****** and he stated he could not get the parts. We have tried working with him to get the **** fixed however he continues to make up excuses and not answer our phone calls. It seems he took our money and never did the work. It is currently 90 degree heat in ******* and this is an urgent matter. We would like our money back since we will now have to hire an emergency **** company tomorrow to come complete the work he never completed.

    ****** Rock and ***** Rock failed to have yearly maintenance done on their units and their current breaker box is from 1980 and needs to be updated. I have video footage of the breaker that was bad and the correspondence between ***** ******* and I stating that the outdoor compressor on the air conditioner has failed due to the breaker grounding out. The unit would have been under manufacture warranty, but due to lack of maintenance, they are not covering this under warranty. I ordered the parts with my own money and there was a 6 to 8 week timeframe for the part to come. The house is currently vacant and I have been in constant contact as I have the text to show. It has now been five days Since the part was ordered, and they said it can take up to 6 to 8 weeks. ****** Rock is being impatient as she believes this part should be covered under warranty and this part should be available immediately. I had to order the part  from *******************. I have the receipts to show.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

    We have paid for the work via ***** to Justins mom ***** ****** over a month ago which I have provided the receipt showing proof of payment along with the signed contract from ****** saying he would complete the work.

     

    We have been home for two weeks now and have been calling him non stop to come fix the ** which he told us was fixed last month  

    He has not been responding and now we have to have an emergency company come fix our system since it is 90 degree heat and he took our money and has ghosted us 

    I do have phone records showing this  

    At this point we are requesting a refund of ******* which we paid for this job which has not been completed.
