    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

The company has not addressed the issue. The owner refused to come to a compromise regarding replacing the ** or a refund. The banks job is not to decide which is at fault but to clear itself of any financial error and any wrong doing and to ensure that the transaction wasnt their fault. When I purchased the **, I then left the store to get an appropriate vehicle at that time, it was sitting on the counter, and when I came back the staff had placed the ** in a box. As circle city stated in their response, it would take 2-3 people to lift such **. It is unknown if 2-3 people actually handled the ** Because I was not present. I can only assume that the damage occurred while placing the ** in the box. It would be insane to pay $1,300 or more twice for another ** losing the other, when the first one shouldve been working in the first place. I trusted this business and at this point i feel robbed, I work hard for my money and trusted this establishment with it when I couldve gone to ******* or Best Buy who would've taken care of me. I came to look around with no intention of buying any **, I drove a car ****** Avalon to be precise. And after seeing this ** 86 ** and purchased it, the salesman asked me what type of vehicle I had I told him that was when he said the ** will not fit in a car. I told him sure I know that. I left went home and brought an ***. I placed pictures of the *** I drove the first time to pick up the ** in which the salesman said the ** will fit in the trunk. He proceeded to measurement of the ** inside the store, then came returned to my *** and measured the trunk and stated that the ** will fit. He went back into the store and single handedly brought the ** outside himself while I was outside waiting for him with my vehicle. When he came out with the **, he the salesman  and I carefully picked the ** up and placed it in the trunk of my ***,at that point I told him that I dont think this ** will fit in the trunk which he disagreed with me because he trusted HIS measurement. When he finally finds out that the ** will not fit,We brought the ** down and placed it back on the flatbed cart and again he single handedly wheeled ** back into the store and I left. On 6/26/22 which is the NEXT DAY, which means time has passed while the ** was still in their possession, I went back to the store with a friend and a flat open bed pick up truck. On this day a different salesman wheeled the ** out single handedly by himself, my friend and I helped him and placed the ** in the open pick up truck. When we got home, we unboxed the **, plugged it up and that is when I noticed the ** was not working properly after seeing it working just fine at the time of purchase. I immediately rushed back to the store and told the young man what the ** did when I turned it on and I showed him the picture on my phone as well which he forwarded to his own phone via Bluetooth. He then said I should go and bring it back. I left the store went back home, my friend and I brought the ** back to the store same day. Picking up the ** from the store and returning it back to the store all within ***** minutes. I asked the young man for the manager and he said the manager wasnt in, I requested a courtesy call to the owner I was denied the opportunity to speak to him. Not at this point, the manager ***** has offered to replace the ** 86 ** with a different ** I believe to be 85 **** or ******* with additional $300 on top off of the $1300 i already paid and obviously lost. I was willing to sacrifice that additional $300 and I was trusting this business to do right by me,but the owner refused to stand by The offer that the store manager had given me. When I reiterated what his manager had offered to me, that I would need to pay the additional $300 his exact response was,Im the owner she just works for me I wont do that! If you want a replacement you will have to pay my full price I cant help you. So at this point I have been robbed of my hard earned money that i trusted with this store instead of other Big name stores, I am just asking that this owner do the right thing by trusting and honoring the offer of the store manager that he chose and hired.   Sent from Yahoo Mail for iPhone

e,we open the ** box, brought it out of the box and plugged it up.At that point we find out that the ** was going out.I immediately called circle city pawn shop and my exact word to the young man was,How come you guys sold a broken ** to me Im bringing it back now and he said thats fine.I returned the ** same day.I requested to speak with the manager the sales man said she was gone. I requested to speak with the owner, I was told he was on vacation and he doesnt want to be bothered.I said to the sales man that we are talking about $1,300 here he seems not to care.Even the sales lady verbally said to me when I paid for the ** that I have 30 days money back guarantee.I patiently waited for the owner to return from his vacation after my children had been and still without a ** in the house. He said if I want a replacement I will have to pay full price if not my $1,300 is gone. Please I want BBB to help me get a replacement ** or my money back.Circle city pawn shop has their ***

    Business Response

    Date: 09/21/2022

The customer purchased the floor model ** from our store. We instructed them on 2 separate occasions that the vehicle they have will not be sufficient for moving a ** this large. We even suggested a trailer or a rental van from the local Uhaul. They returned and insisted that the vehicle they have will be good enough. The complainant alleges that the ** was going out but once they brought it back, the screen is actually broken which usually results from improper transport. We have sold hundreds of **'s and even offer free delivery up to a certain radius. Given that I was on vacation, they opted to move the unit themselves. This usually requires 2-3 people to move due to it's size and weight. They then refuted the charge through their credit card company and was awarded their money back. We then filed a dispute and after 10 days we were deemed not to be at fault. They did not return to the store the entire time until they were ruled against. We offered to give them another unit at cost but they refused. Our 30 day guarantee covers everything with the exception of a broken screen. We are not in the business of leaving a customer dissatisfied but we can't give a refund for personal responsibility once it leaves our store. At the bottom of the receipt that the customer provided, it states all sales are final but out of courtesy we cover the first 30 days against any malfunctions other than physical damage made by the customer.
