    I recently closed on a property and I used Monument Title. They calculated my Tax payment based on an old assessment that was substantially higher than the value at the time of the closing. I did not catch this initially until after the closing. When I reached out to the Title company, Monument Title in ************, they hid behind a document that they had us sign that we would not hold them harmless fo their mistakes. Rather than help me to try to make the situation right, they said "we are not responsible because we got a different assessed value. Too bad, **** it up and get over it is basically what the attorney told me, ********. This error cost me thousands of dollars.

    Good Afternoon,

    I am General Counsel for Monument Title Insurance Company.  We received a complaint from the customer that there was an issue with the tax assessment at the county level in that the taxes were re-assessed outside the normal time frame and he was owed a refund.

    By way of background, we are a title company that closes real estate transactions.  We prorated the taxes on the settlement statement, which was signed under the statement "Approved and Accepted" by *************************, Managing Member of Nu-Life Property Solutions LLC who took title as Nu-Life Property Solutions Corp.  (Said settlement statement is not attached as we would prefer to have authorization from the customers in order to release said document as it contains all the financial information of the transaction.)  ************** did not raise any issue related to the taxes at that time.

    ************** also signed the attached Tax Hold Harmless stating he would hold harmless Monument Title Insurance Company LLC from "any and all claims, demands, or causes of action in any way related to the use of the amounts stated above for purposes of calculating the settlement statement in closing the transaction associated herewith."

    Upon receipt of ****************** complaint, we did remind of the hold harmless he executed and explained our role in the process. .

    We additionally reached out to the other party in the transaction to attempt to facilitate communication between the parties to resolve the issue, though this was not immediately communicated to ************** and that discussion is ongoing.

    We have further reviewed the file and decided to issue a check to ************** for the difference in taxes for the proration.  The attached communication will show that we are communicating this with ***************

    As an aside, I received the complaint Tuesday and we have immediately taken action.
