I signed a year lease with ****** Reality in 2019. November 13th 2020 is when I was contacted by Taflinger Group to let me no that it was no longer through ******. I have several messages of me letting ****** know that I was looking to move from my current home.***** left and I was notified September 9th through text message. While I have been here my home has flooded multiple times from my washer and the exit hose from the plumming have been in my yard. They sent someone out days later and they clogged the outside hose. I have been here 3 years as of October 9th. I have domestic stuff going on and threats have been made to me from peers my back door has been kicked in not even 12 hours ago and I have to file a report I have just tried to nail it shut .I have 5 small children and I dont feel safe here I am in fear for my life and will make a police report. When I called Taflinger trying to give them notice I was told I couldnt move until October of 2023 I can not live here another year.

    Business Response

    Date: 10/25/2022

    Good morning,

We received the above complaint in the mail.  I wanted to respond.  We have been speaking with section 8 regarding this tenant as this tenant receives a voucher for her rent.

Because she receives a voucher through section 8, and did not notify section 8 of her wish to move, or provide written notice 30-days before her October 1st recertification date, her section 8 contract auto-renewed.

After speaking with section 8, her caseworker stated that the tenant did not provide them notice and that the tenant was told to reach out to us because her lease auto-renews on October 1st.  The process is to provide the landlord a written 30-day notice and a copy of the notice provided by the tenant to section 8. What happened was the tenant failed to notify either party (section 8 and Taflinger Group), and her contract auto-renewed.  Per section 8, the tenant went to look at houses prior to informing them and placed a deposit on a home last week.

We let the tenant know that 30-days before her lease expires next year, we would be happy to accept notice.  Unfortunately, she was not happy and she hung up.  She called back to say that she was speaking to ***** (previous manager) and that he knew.  This is incorrect as the owner of the company was managing the rentals from August until October 3rd, we have no record of the tenant providing notice.  Our office is open, we have a drop box, she knows our address, and our emails.  She failed to provide notice.

She called back again, an hour later, and she proceeded to say that it doesn't matter about the notice as she has a domestic situation happening.  We were unaware of any domestic issue until she mentioned it during the call last week.  We asked for a police report and other documentation regarding a domestic issue and she said that she did not have anything.

She said she should be able to get out of her lease just by stating that there is a domestic issue.  This is incorrect, we have policies and procedures in place for those issues, and we submit all proof to our attorney to review before any decisions are made. We have not received any documentation.

She said she was going to file a complaint against us because we wouldn't let her out of her lease.  She called section 8 to complain, and was informed that she failed to provide notice and it is up to the landlord if they wish to cancel the 1 year lease.  We do not wish to let her out of her lease as it is a legal binding contract.

Regarding her sewer issue: she is flushing wipes and sanitary waste down the drains, per the plumber, and we have asked her not to.  She continues to flush them and clog the drain.

    Thank you,

    *******
