      MAC Construction is excavating in Liberty St. in Louisville, KY and surrounding streets-since 23 June 2023, and are presently working that same site location. I was in the area at this time when my driver front tire was punctured with a silver metal screw that destroyed the tire. I have been getting the runaround from ***** ***************and the onsite manager of MAC Construction. After 4-5 false contact numbers and responses "You're not going to get anything-ma;am; I asked for the name and address of the Risk Management so that I can take the company to small claims court to see how the judge will rule, the on=site manager then proceeded to give me the correct phone number. He said, "Try this one". The number, *************, belongs to ***** ********* Safety Coordinator for MAC Construction, and address my Tire-Replacement Safety/Risk Management Complaint. On the 29th of August, ***** ********* texted me from her work cell # ************* stating: "Could you please send any photos you have to this number, the other one was a landline. I'm also trying to find out a few details about the incident and where exactly it occurred, date, time, etc. if you wouldn't mind giving me a ring whenever you have a moment. Thank you." I attached the 4 tire photos, two estimates, and the following claim information details from the (812) # to her work cell (502) "To my best recollection, the incident occurred 23rd June 2023. on **** ***** ** ** ******* *** Front of car facing east on Liberty St (one way) I have a 2021 Dodge Journey Crossroad. As you can see the nail resembles a cement screw. I then called ****** per her request, and she identified that the nail is a part of debris due to the type of work MAC Construction performs. ***** also stated that she has had this same puncture- issue happen to her tires at least 3x. I replied, "Good. So, what is the turnaround time to receive a tire-replacement check? ***** responded "Give me till Friday (01st September). Yesterday, I received a letter of correspondence from MAC's Director of EHS, **** ***** *************, denying my claim, I am requesting BBB to mediate on my behalf.

      I am rejecting this response because:  There was a manager of operations that knocked on residents doors stating the water would be out for hours the following day; and to make provisions that day for bathing and drinking. The manager handed business card in August from Mac Construction.

      Also, there were no barricades out, this was missed debris from cleaning. I have evidence  of missed debris this past Sunday from their most recent work last month. I "thank God" we saw before parking.

      I have letters that were posted on residents doors proving different.

      What is mind blowing to me is Mac Construction's denial of untidiness of cleanup; and arrogance to be irresponsible to do the right thing which is to replace my tire.

      I am rejecting this response because: These objects are not necessarily used to rebuild as part of the excavation. The entire street was broken up, any and every type of objects can be there. Very old out dated plumbing. 

      I am a law abiding citizen. Clean MVR. No violations. I entered the ******* ****** area because there were no signs or barricades present.

      All I know is that my tires were fine when I parked my vehicle in a travel free zone; after having visited, enroute  home, I had a flat tire. ******* ****** was my only destination that day. Visit this Street for many many years; never incurred safety incidents; here has never been this type of construction until the present. And this is when I received a flat tire. The debris of all kinds comes from city-street-demolition work of the entire street. Which makes Mac Construction liable for this, whether they used the material or not. Their excavation and improper clean up caused a hazardous situation for me. If the street was impassable; the signs should have remain. There were no detour signs for ******* ****** at that time, so I parked my vehicle in what I thought was a safety zone. Mac Construction. Please accept your negligence in this matter; and replace my tire at your expense today.

      I am rejecting this response because:  The CLEAN-UP crew of Mac Construction was NEGLIENT; THEREFORE, RESPONSIBLE FOR THE RESIDUE OF DEBRIS LEFT BEHIND; AND LIABLE FOR THE DAMAGES SUSTAINED BY A LAW-ABIDING CITIZENS, TO MAKE THEM WHOLE AGAIN, WITH NO COST COMING OUT OF HER POCKET. 

      I AM ASKING FOR FULL REPLACEMENT COST OF THIS TIRE (CHOOSE ONE OF THE ESTIMATES ALREADY SUBMITTED); PAIN AND PERJUTY (EMOTIONAL STRESS AND THE LIES SPOKEN AGAINST MY CHARACTERAND INTELLECT) WITH HAVING TO FIGHT FOR WHAT IS THE RIGHT THING AN EXCAVATING CONSTRUCTION COMPANY TO DO.
