      I am filing a formal complaint against KCS Foundation and Waterproofing Specialists for misdiagnosed work that led to unresolved structural issues, worsening damage, and financial loss. I paid $22,115 for foundation pier installation based on their recommendation to correct interior movement (cracks, floor shifts, sticking doors). These issues continued, and new damage appeared—including a dropped wall, worsening cracks, and more.

      The first phase of work occurred in April 2024. On October 31, 2024, I paid $8,415 for a second phase, marketed as a final fix. Although the initial payment is just outside BBB’s 12-month window, the October work falls well within it. The project remains unresolved as of May 2025.

      Key Concerns:
      • Original issues remain, and new structural damage has developed (Attachments A & D).
      • KCS was repeatedly informed of interior movement but continued recommending exterior piers without addressing drainage (Attachments B & E).
      • Despite advertising drainage services, KCS failed to act on visible erosion for over a year—while outside professionals identified it immediately (Attachments B & C).
      • KCS’s foundation expert admitted he could not assess whether the work caused new damage, as he never saw the home beforehand (Attachment C).
      • Independent engineers later identified drainage and slab settlement as the true cause (Attachment C).
      • KCS’s own salesman later claimed erosion was observed from the start—yet no mitigation was offered.
      Requested Resolution:
      See Attachment K for formal request (full refund or corrective action with independent oversight).

      This complaint is supported by expert statements, full documentation, and a complete timeline. Copies have also been submitted to the Kentucky and Indiana Attorneys General and the Indiana Professional Licensing Agency. I respectfully request appropriate resolution within 30 days or I will pursue all available legal remedies. Thank you to the BBB for your assistance in resolving this matter.

      The home in question sits on a hill. We inspected the home and recommended the installation of stabilization piers along the left, downhill, side of the house to stop its movement.  The homeowner called several months later and said the problems were continuing.  The original piering system was tested and found to be fine. Based upon our investigation, we recommended that a similar piering system be installed on the right side of the home in case the uphill side also needed to be stabilized.  After a few more months, the homeowner advised that there were problems with cracks and settling in the interior of her home.  We inspected the areas of concern and were given permission to cut through the cement slab floor to investigate.  At that time, we found that there was an open area beneath the slab floor of approximately 200 square feet that was caused by a improperly installed subfloor drainage system connected to an inoperable sump pump. We had no reason to suspect these hidden issues when we performed our work to stabilize the exterior foundation of the house.  Both a certified structural technician and a professional engineer also examined the house. They both found that the stabilization piers we had installed were performing as intended. However, they both said that the hidden void under the house, caused by the erosion which resulted from the inoperative subfloor drainage system, was the cause of the continuing problems and needed to be addressed. The response above is just a summary of the facts of this case. The limitations of the BBB's response procedure would not let us go into all of the details. In summary, the work performed by KCS was necessary, and is functioning properly, but the concealed problems under the floor of the house will need to be addressed to fully resolve the homeowner's complaints.

      I am rejecting this response because:

      The company’s reply summarizes events from their perspective but avoids the core issue: KCS misdiagnosed the cause of structural movement in my home, sold me $22,115 in foundation piers that failed to resolve the problem, and now refuses to take responsibility.
      KCS continues to cite my home’s hilltop location as justification, yet they cannot point to a single issue the piers actually resolved. They ignored the interior areas where visible damage existed—especially the center of the home—and instead installed piers along exterior walls that showed no signs of failure.
      The “void under the slab” they now cite was discovered only after I demanded further investigation. Drainage issues, erosion, and a non-functioning sump pump were visible from the beginning. It is deeply concerning that a company advertising drainage and waterproofing services failed to identify these issues for over a year, while independent experts did so within minutes.
      KCS claims their foundation expert confirmed the piers are working. What they do not disclose is that this expert—Todd Unser—is a KCS employee (see attached). He presented himself as unaffiliated, said he had only “met the owner in passing,” and warned me against pursuing further action because, in his expert opinion, “I would lose.” That is a serious conflict of interest.
      Also troubling is that after I posted a detailed Google review, the company responded publicly—yet once I edited my reply, the review became invisible. This kind of “shadow banning” raises valid concerns about online transparency and reputation management.
      I submitted this complaint in good faith, seeking a fair resolution. Instead, I received mischaracterization. My request remains the same: a full refund or corrective action as outlined in Attachment K, overseen by an independent expert. I will continue pursuing all appropriate regulatory and legal remedies.

      I would like to reject the offer of Mediation for complaint ID ********.

      Thank you for your offer to initiate formal mediation. At this time, I do not believe that mediation would be a productive path forward, as the company has already been given multiple opportunities to resolve this matter and has chosen not to engage meaningfully. I am currently pursuing this case through the Kentucky Office of the Attorney General and will continue to explore every other legal remedies as necessary.
      I appreciate the BBB's efforts to support consumers in these situations.
