    Bought a ag disc thru a public auction for 800 plus 900 shipping. Photo looked good. Both tires up, Disc gangs all present. “As is” means that the seller must specify any UNSEEN defects that would take away the value/functionality of the disc. The description did mention a couple of disc blades were cracked. I can handle that. One disc gang would mot turn. One wheel was bad. Disc inoperative “as is”. Legally “as is” means seller is not responsible for any seen defects. Defects that are NOT SEEN BUT ARE DETRIMENTAL NEED TO BE REPORTED.

    To whom this may concern, *** **** purchased an ************* ** ***** **** off our online auction through ******* ***** When purchasing on ** ******** ***** through *** ******** **** ********** there are photos and videos of the item. This particular item had one video and 20 photos. I have attached the listing with the description for you to see that. We stated in the description "International 37 Disk - Pull Type, 10.5ft In Front, 7.5inch Spacing, 16inch Front Blades, 15inch Rear Blades, Adjustable Tongue & Gangs, Chipped Blade On Rear ~5% Buyers Premium Added To Final Cost ~ *See Pics & Video For More Details *Sells Absolute! ~Please Read Terms & Conditions Before Bidding* ". **** ******* (owner o* ******* **** *********) who recently passed away on Feb 3, 2025 stated everything that he seen was wrong/right with this disk. Because of his passing, there is NO way for me to have a conversation with him and ask him if he noticed the disc gang not turning. Keep in mind, we did not hook this up and put this in the field or call it field ready. For us to know the full functionality of the disk, it would have had to be hooked up. We don't advertise our equipment for that reason. We also state "*See Pics & Video For More Details *Sells Absolute! ~Please Read Terms & Conditions Before Bidding*". We let all our customers make the call on what they see and do not see. We did not force *** **** to purchase this disk and in fact we encourage ALL our customer to visit our lot and look at what they are bidding on... as stated in the following terms and conditions.

    All equipment is sold "As Is Where Is" with no guarantees. All sales are final.
    Please call with questions before making a bid. We encourage self-inspections before bidding.

    **No equipment will be released until payment is made in full**
    • 5% Buyers Premium will be added on all Auction Time items.
    • Personal checks are accepted with proof of a valid driver’s license.
    • Credit Cards are accepted under $2,500.00 with an additional 4% fee.
    • Accepted Credit Cards include Master Card, Visa & Discover.
    • Wires are accepted with a $20.00 fee.

    **All Sales may be subject to Indiana 7% Sales Tax**
    • Customer's may fill out a Sales Tax-Exemption form for those items to be used in the "Direct Production" of Agricultural.
    • We MUST either have a Sales Tax-Exempt form on file for any equipment applicable to be tax exempt or sales tax MUST be paid before any item is released.
    *** **** needed to and should have read through ALL terms and conditions before bidding on the item which is stated. With all that being said... 
    He then bid the disk up to $800.00 with a 5% buyers premium being $40.00. He was not sales tax exempt for farm use so rightfully there was another 7% added to his bill. *** **** then asked BFM set up freight for him which is an additional cost. After running the miles, it was $900.00 more. In total his bill was $1,598.80 which he paid in full on 1-9-25.  
    Disk was delivered on January 31st to the address of **** * ****** ** ** ***** ***** *** requested by *** ****. We received a voicemail complaint on February 8th (Saturday) at 12:39pm. We were closed this day for Bill Bingham's funeral. In this voicemail *** **** stated the disk did not last a mile until the tires were shot and that would be $50.00. He also said the disc gang would hardly turn. He was upset and I understood. I then called him that following Monday, February 10th and kindly listened to his concerns. He let me know he had already filed a complaint on us to the BBB, instead of giving us a chance and to see what we could help him with. I talked with ** ******m who is now in charge, and he agreed to giving *** **** his full money for the disk if he brought it back. 
    I talked then with *** **** and that was not good enough for him, he wanted his entire money back and then proceeded to hang up on me. He called back the next day to let us know there was a machine shop nearby that may fix it. ** ******m agreed to sending $200.00 to *** **** to help with the cost of the repairs for this disk. He also did not like that response and hung up on us. 
    We have been more that fair with *** ****. He has stated multiple times that he is a human being and just wants a disk that works. We are also human beings. Bingham Farm Machinery has been more than fair with offering *** **** repair money or a full return for the disk ONLY. We cannot refund the amount of the freight to him because that is an additional cost for the truck driver who we outsource. 
    He has been harassing us, and we would no longer like to do business with *** ****.

    I am rejecting this response because:

    Hi, the number of my complaint is ******** and my my name is *** ***. And their their response, they sent a response to me, the the people that that sold me the disk and they said, if I am willing to spend the shipping amount to send it back down there to send the debt back down to Bingham's, they will refund my money. Now here is my response to that is it is going to cost me more money to ship it back than what I paid for the disk. So the answer to that is no, and my 2 solutions, you know, to this problem is I will gladly let them come up here and take the desk back if I can get my full refund back, if I can get my the total amount of my money back or this might even be a better feasible option if they will have get fixed up here, you know, so just so it is working, all I want is a disk that is working if they will reach, you know, they will pay for the whatever it costs to fix the disk. But anyways, those are my 2 solutions and I do not know whether what they are going to say. So thank you, bye.
